In the newest issue of 52 Luthor makes a crack about how America is great because a boy from Smallville can grow up to be president of the united states. So it would appear that part of Birthright/Silver Age continuity is still officially in.

no, the way he said it he was definitly reffering to himself...he was doing it in a jokey way...and yes, they've said Birthright is out of continuity

Well....I've heard they wanna connect the comics more to the SV and even the movies. I think the newest Fortress of Solitude is exactly like the movie version.
