The people who own the film rights aren't going to just give them up. If it was not in the original contract that the creator retained their rights to the intellectual property, then there is nothing really to be done if the film property owners decide to be assholish. Stan Lee had to sue, if I am not mistaken, to see profit from the SPider-Man movies, because even though he was the original creator, the rights had since been given to Marvel Entertainment, which is why some of the most influential incidents in Spider-Man's history were written by others. If the film property owner decides to be dickish, technically the film rights are different than the character writes. Its all very complicated stuff.
