But including Superman after 2013 would need involvement of Siegel and Shusters in some capacity due to ongoing Lawsuit.

So, considering that, they would want to green light a JL movie before 2013 ends.
That means that They have to keep it in a separate continuity.

But, I may be wrong here.

Man of Steel as a franchise can continue unimpeded from the lawsuit. So if WB cannot negotiate a settlement with the heirs, the Superman in JL will be the Man of Steel Superman.
