Also if Marvel doesnt put out Xtoys, then the merchandise companies can focus more on Disney toys for Disney's other movies.
I really don't see it as being that vicious, with all that time devoted to thinking about a rival. It's not good business practice to spend all your time worrying about what someone else is doing. You just get on and do what you do, with maybe an eye on the competition but not an obsessive campaign against them.

Even if Marvel got the X-Men back, they wouldn't have time to do anything with them. They would put them on the shelf like Punisher, Blade, Ghost Rider, Daredevil, etc.

Marvel/Disney are just doing what they do and doing it well - the superhero films are generally well-received, the marketing is brilliant and the box office is very good. I would hardly think Fox's output is on their radar. They've got Doctor Strange, Ant-Man, Inhumans and tons of other stuff to think about. Why would they waste time thinking about X-Men? They certainly aren't going to go out of their way to promote or help the X-Men movies, but they won't be wasting time on negative stuff either.

Fox only has itself to blame for the dips in quality a few years back (X3, Origins, F4 1 and 2, Elektra, Daredevil). Marvel didn't cause any of that.

Show me an X-Men comic where Mystique is the leader and walks round all day as a bored blonde
