Not that i don't agree but, just because he could be doing police duties doesn't mean he's Harvey Dent lite. That's being really narrow just for the sake of seeming right.

Plus, I was there...I saw what he was doing the entire time. Before these photos surfaced I said he was shooting at Mercs and Holding A walkie talkie, neither of these bar in my mind that he may be D.A. Again while D.A. is the last on my list, I'm not going to say its absurd that he's D.A. when we've got possible Earthquake machines, Batprawns and a whole former movie where the district attorney did a hell of a lot of things during a time of crisis.

It could easily be explained away. Thomas Nixon (I made the name up) former Gotham State Police Chief, now State Prosecutor is called into Gotham city when Comissioner Gordon is injured in an attack to round up the recent rash of crimes in the city planned by Bane.

I'm just saying keep an open mind at this point.

Though the Name Nixon and the implications of that name with the FBI are leaning me towards that the most

I think it makes a lot more sense for Modine to be Acting Commissioner rather than the new district attorney. Perhaps someone new brought-in after Gordon's absence.

DA is my lowest thought but, I'm not convinced he's NOT a D.A. just yet, especially with his striking resemblance to Harvey Dent.

Precisely the reason why people think he's a DA. In fact, the only reason. Why would Nolan repeat himself so obviously? I'm willing to bet my house on the fact that Modine is indeed an FBI agent or some type of high ranking cop. You will not find a DA putting himself in this position - not even on the worst day - that just isn't their job- it makes no sense.

I keep seeing people insist this has to happen but, it was never clear to me why...

It's almost a staple. It would feel incomplete for me if we don't see at least one scene of Batman on top of some building.

No; because Modine's character was shooting at the bikes when they get away
