Speaking of law suits,

Nokia Lumia and the new iPod Nano: One of these things is not like the other

Quote:
Uh oh, is that the smell of lawsuit floating in the air? Probably not as the image that you see below was made for humorous purposes, not to accuse any company of stealing others' ideas. But on the other hand, it demonstrates how the design of the new iPod nano might have been "inspired" by the looks of the Nokia Lumia 800. Or it could also have been the other way around as the old nano shares more than a few visual cues with the Lumia 800, such as the edgy top corners, rounded sides, curvy screen plates, and bright, quirky colors, not to mention that the smartphone kind of looks like two nanos stacked on top of each other.

Thankfully, a legal battle between Apple and Nokia seems unlikely at this time, despite the visual similarities between these devices. After all, you can't really put a patent on rounded corners so that you can sue other companies, right? Oh wait, turns out you can.
Also in Windows Phone news,

Microsoft Pulls Back On Windows Phone 7.8 Features Request

Quote:
Just a few days ago, we reported that Microsoft was seeking feedback from users on the Windows Phone UserVoice site about what features they wanted to see integrated into Windows Phone 7.8. The premise had a lot of people excited, but may have misled some into thinking there would be high levels of support and development. To their credit, the Windows Phone team was specific in their message, however you can also see how this would incite quite a bit of activity, as the Windows Phone 7.x environment does lack a lot of features compared to the competition.

“As you know, Windows Phone 8 is a generational shift in technology, which means that it will not run on existing hardware. BUT we care deeply about our existing customers and would like to know SPECIFICALLY what features you would like to see on 7.8 and vote INDIVIDUALLY for the one that you want most (vs. one large grab bag of features).”

Well, the user response was rather spirited, one might say. Thousands of responses and votes, and just a few days later, Microsoft updated their position.

“We are truly floored over the excitement about future Windows Phone releases. Unfortunately our earlier response on this post was not well worded. We really do care about your feedback. This forum is intended to seek suggestions on future product features but it is not set up to take requests for specific product versions. We apologize for the confusion.

We would like to reinforce that for this forum to work optimally we would need users to create unique suggestions each with a single idea. This particular suggestion item has many varied ideas and because of that we aren’t able to infer what is the most important to this forum. Please reallocate your votes to other suggestions that have a single idea.”

Now one might view this as an attempt to walk away from the idea, but the operative wording for "users to create unique suggestions each with a single idea" and to “reallocate your votes to other suggestions that have a single idea” is what is important. If you browse through the UserVoice site, you can see that a huge portion of the responses were veritable laundry lists of features being requested. It would stand to argue that the Windows Phone team was looking to aggregate the most common feature requests. Unfortunately, rather than setting up a single-selection survey, they positioned themselves to be on the receiving end of a tidal wave.

So, if you had to pick only ONE feature what would it be? In the Windows Phone 7.x ecosystem that is not such an easy question to answer.
Also I would like to ask now that Motorola Mobility is a part of Google will that mean the next Nexus phone will be developed by them and will it be called the Google Droid Nexus/Razr Nexus?

In Google Nexus news,

The Next Big Thing for Nexus

Quote:
The Apple iPhone 5 is out and it’s a solid upgrade all over - bigger, 4-inch screen, 4G LTE and 2x faster processor and graphics, and more. Now, that we’re done with it, what’s the next big thing that’s coming out?

Well, there are a couple of things in the coming days like a monstrous LG Optimus G set to make a debut next week, along with new HTC devices and a Motorola Intel-based phone, but one device we have heard almost nothing about has been the Google Nexus smartphone.

Last year, it was in late October when Google’s mobile head Andy Rubin took the stage with Samsung to announce the Galaxy Nexus, and it has really withstood the test of time and graciously aged getting a more and more affordable price. It’s still $350 off contract, and it’s one of the most affordable phones offering great bang for the buck.

But is a new Nexus coming this year? If it is, than it has been a secret better kept than the iPhone (which was - intentionally or not - leaked out all over the place). We believe it is coming, though, and not just one, but many Nexus phones.

Here is what we know so far. First, the Wall Street Journal - which happened to be perfectly right with all its scoops about the iPhone 5 - claimed back in May that Google is working with not just one company for the new Nexus, but with a few manufacturers for multiple smartphones under the Nexus brand. Moreover, it was claimed that Nexus phones should be out by Thanksgiving, which falls on November 22nd this year.

The leaked specs for an alleged Galaxy Nexus II, the I9260

This would mean that multiple phone makers have gotten early access to Jelly Bean and have had plenty of time to create new devices. Who’s in the mix? A more recent rumor says we’ll see three new Nexus phones:
- the Samsung Galaxy Nexus II
- LG Optimus Nexus
- Sony Xperia Nexus

I've told myself if I stay with Android the only phone I would get, this coming upgrade, was a Galaxy or Nexus phone. Right now, I'm thinking of getting the Ativ S or the Lumia 920, I've been interested in Windows Phone since the first Focus.

Galaxy's are awesome. If Samsung does come out with another Nexus, it better not suck like their last one.

Apple Wins Injunction Against Motorola in Germany

Quote:
Apple has a real chance to do some damage to Google by way of a court decision it won in Germany's Munich I Regional Court against Motorola Mobility. The company, wholly owned by Google, was found to have infringed on an Apple patent covering the "rubber-banding" effect, also known as the "over-scroll bounce". It is the bounce back that occurs when you scroll down to the end of a list and is covered in EP2126678, the European equivalent of U.S. Patent No. 7,469,381. The decision was announced by Judge Dr. Peter Guntz

The problem for Motorola Mobility is that by posting a €25 million ($32 million USD) bond, Apple can have a country-wide injunction put into effect. While it is a permanent injunction, it still can be reversed on appeal. Putting up another €10 million ($12.9 million USD) will allow Apple to have the infringing devices destroyed and for another €10 million, it can ask for a recall which would take any infringing device out of the hands of current owners. The court also found that Motorola owes Apple from past cases in the country. Motorola Mobility is going to appeal the decision to the Munich Higher Regional Court and argue to the European Patent Office that the patent is not valid in the first place. There is a workaround for Motorola in the stock Android experience. Instead of a "rubber-banding" effect, stock Android has a "glow" at the end of a list. For Android users, this does not does the job as well as the bounce does.

Apple has won injunctions on Motorola twice before this year in Munich. One was for the "slide-to-unlock" patent, while the other dealt with the photo gallery page flipping patent, Overall, in Germany, Motorola has been found by the courts to have infringed on three Apple patents and two belonging to Microsoft. Luckily for Motorola, its market share in the country is fairly low. But for Android overall, Apple's suits are a problem that is not just going to go away by wishful thinking. Coming up in Germany is a Apple-Samsung patent trial set to start on December 7th.
AT&T Not Offering Upgrade Pricing for iPhone 5 to iPhone 4S Customers

Quote:
Have you checked your eligibility to see if you can pick up a new iPhone 5 with subsidized pricing? With previous releases of the iconic iPhone, AT&T has offered upgrade pricing to many customers who had purchased the previous year’s model. It looks like AT&T will not be making such offers this year.

This comes as no surprise, as AT&T has been tightening the belt with regards to subsidies and data plan pricing. Add the fact that AT&T will be requiring its customers to sign up for its Mobile Share service to use Facetime over cellular, and you see the trend that AT&T is pursuing with its pricing and subsidies.

There have been some customer reports that AT&T customer service reps were pinning the upgrade policy on Apple, which is highly suspect, as Apple would be more than happy to sell more iPhones to AT&T.

If you are an AT&T customer with an iPhone 4S, and were thinking of upgrading let us know if you are being offered an upgrade price or not.

Carrier Support for Windows Phone 8 is Strong

Quote:
It is not just sympathetic support for Nokia, US carriers are voicing excitement over the upcoming Microsoft Windows Phone 8 release. At a Mobile Future Forward conference in Seattle, The Motley Fool reports that carrier executives were “falling over themselves” to express support for the new generation of Windows Phone.

AT&T’s Glen Lurie, who gets to test out all new devices before they are offered to customers, said, “I’m bullish on Windows 8…it’s hard to bet against a tablet that does what your PC and desktop will do.” Sprint’s president of network operations, Steve Elfman agreed while noting that adaptation will need to be broad in order for Windows Phone 8 to be a viable competitor to the iPhone and Android devices.

Verizon already openly voiced their support for Windows Phone 8, confirming they had an agreement with Nokia and that the carrier would have more than one Windows Phone 8 device available. T-Mobile USA’s VP, Brad Duea, apparently at a loss for words said, “It’s exciting.”

The carriers are excited about Windows Phone 8 because of it appears the platform overall will actually be able to effectively compete in the market with Android and Apple’s iPhone. More than that, the carriers want a viable, large third platform in the game because such competition helps to keep costs contained. Think about how much money a carrier shells out to have an iPhone in stock now, then imagine what Apple’s prices would be if not for Google and its Android operating system.

It will be interesting to see how much marketing the carriers throw behind Windows Phone 8 when it debuts in the next several weeks. Of course, we cannot wait to get our hands on all the new devices lining up in the queue as well.

HP Confirmed to be Working on Smartphone

Quote:
HP's new CEO Meg Whitman is apparently not willing to go down without a fight in the smartphone arena. Asked in an interview with a business news outlet, she commented that HP "ultimately has to offer a smartphone", and that they are "working on it". She also said "my mantra to the team is better right than faster".

While this is interesting enough, considering that HP just got off that bandwagon recently when it open-sourced Palm's webOS, and discontinued its phone and tablet efforts with it, we are bugged more by what operating system does HP intend to use.

Close ties with Microsoft are a traditional stronghold for HP, but they said no to Windows RT tablets, and will only be making Win 8 slates, for example. HP is pretty far removed from Google and Android, and trying to resurrect webOS might be doomed. A whole lot of questions coming out of this interview, hopefully we will get some answers soon.

ITC Judge Says Apple Did Not Infringe Samsung Patents

Quote:
An ITC judge ruled on Friday that Apple did not infringe on any of four Samsung patents that the Korean manufacturer said were being illegally used by Apple. Samsung had requested that the Apple devices that it claimed were infringing on its patents be banned from being imported into the United States. But the run of bad luck that Samsung has had in legal matters, continued on Friday when ITC Judge ITC Judge James Gildea made his decision in favor of Cupertino based Apple. Both tech titans are battling it out with each other in ten countries.

Last month, a jury in a U.S. District Court found that Samsung had infringed on a number of Apple's patents and awarded the company $1.05 billion in damages, a figure that Judge Koh could triple at a hearing set for December 6th. In the meantime, Samsung's cross-complaint against Apple went for naught as the jury found that Apple did not infringe on Samsung's patents.

The ITC case decided on Friday was originally filed by Samsung back in the middle of 2011. Now that the judge has made his ruling, it isa up to the full commission to either uphold or overturn the judge's decision which will take place at a hearing in January. For those legal eagles out there, the Samsung-Apple case is 337-794 at the ITC.
Leaked HTC Accord Lacks Micro-SD Support, But Said Takes Amazing Photos

Quote:
Tips continue to trickle in for what will be HTC’s new Windows Phone 8 device. Known as the HTC 8X, code named Accord, it features support for Verizon’s LTE network, an 8-megapixel camera on the back, and a 1.3MP front facing camera.

The device has 16GB of storage, and no slot for expandable memory. Though the “option” to switch storage to an SD was grayed out according to the tipster, so take everything with a grain of salt. The device is said to have a good build quality and, consistent with HTC’s methods, is made of plastic. Windows Phone 8 running on the Accord is bit rough around the edges and “still has some things to clean up.” The 8MP camera is very fast and takes “phenomenal photos.” The current set-up does not indicate any support for features like burst mode or “ImageSense” capability.

We are sure to learn more about the HTC 8X/Accord in the coming weeks. The news about the camera is certainly interesting. This latest rumor is in contrast to previous tips which indicated that the device would have expandable memory. The lack of memory expansion was a sore spot for many Windows Phone users in the past. However, the fact that SD memory card expansion is supported on Windows Phone 8 at all relives a bit of consternation for Windows Phone fans that desire that flexibility.

I think eventually Apple will have to grow a pair & have to start semi being nice to these companies. What is to stop Samsung making parts for Apple ? & is Apple willing to lose its biggest market in China ? What Apple is doing is bad for everyone including Apple

I totally agree with that. I can't remember a time before Apple hit the market with the iPhone that phone manufacturers were so cutthroat.

Sprint and Verizon iPhone 5 Cannot Make Voice Calls and Use LTE Data Simultaneously

Quote:
This probably won't be much of a deal breaker for potential iPhone 5 owners, but we thought it would be good to give you, guys, a heads up, especially now that the smartphone is up for pre-order. Turns out that the iPhone 5 cannot handle voice calls and LTE data at the same time when used on a CDMA network. In other words, Verizon and Sprint iPhone 5 owners will have their LTE data cut off during calls, so their smartphone will have no internet connection unless it is connected to a Wi-Fi network. This limitation won't be present on the AT&T iPhone 5.

Now, this lack of simultaneous voice calls and LTE data probably doesn't make sense to some of you. After all, data will flow over LTE, meaning that the CDMA radio is free to handle voice calls at the same time, right? Well, not really. The thing is that the iPhone 5 uses two antennas for a single call and actively switches between them, depending on which one has better reception. Other smartphone makers use several antennas too, but while one of them is dedicated to voice calls, another one handles data connectivity.

Simply put, the lack of a dedicated antenna for LTE data in the iPhone 5 is in the bottom of all this. Thankfully, as LTE technology evolves, there is hope that the limitation will one day be a thing of the past. Sounds like e good improvement to introduce with an iPhone 5S, don't you think?
Samsung GALAXY Note II to be Released October 21st at AT&T?

Quote:
It has been an impressive year for Samsung. In the first 100 days that it was on the market, the Samsung Galaxy S III sold 20 million units. The OG Samsung GALAXY Note sold an impressive 10 million phablets in a year. And as we told you last week, the tech titan's top mobile executive boldly predicted that the Samsung GALAXY Note II will sell twice the number of units as the original model, or 20 million.

A "respected source" for AT&T has told BGR that AT&T will launch the Samsung GALAXY Note II on October 21st, the same day that the carrier will release the Windows Phone 8 Nokia Lumia 920. But that is another story for another day. Right now, we are focusing on the device with the 5.5 inch screen. Similar to the launch of the Samsung Galaxy S III, you can expect the Samsung GALAXY Note II to be picked up by each of the top four U.S. carriers and U.S. Cellular. It was a strategy that seemed to payoff for the smartphone, so why change things?

The Samsung GALAXY Note II will come to market with that 5.5 inch Super AMOLED screen with resolution of 720 x 1280. That gives you a pixel density of 267ppi. Under the hood is a quad-core 1.6GHz Samsung Exynos 4412 processor with 2GB of RAM aboard. The device will be available in 16GB, 32GB and 64GB variants. An 8MP camera on back offers LED flash and captures video in 1080p at 30fps. The 1.9MP front-facing camera takes self-portraits and allows you to video chat. The 3100mAh battery on board should bring enough power to the device and Android 4.1 is installed.

The Samsung GALAXY Note had practically no challengers in the segment. This time around, Verizon has its version of the 5 inch LG Optimus Vu called the LG Intuition. Perhaps more of a worry to Samsung is the alleged 5 incher coming to Big Red from HTC. We don't know much about it except that it will have a 1080p screen. Will the Samsung GALAXY Note II be able to fend off the tougher competition? We should have a better idea when we get our first report on which tablets are moving during the holiday season.
HP Smartphone Appears in Benchmark Running Android

Quote:
In no time after we see HP's CEO Meg Whitman talk to Fox Business about plans to re-enter the smartphone market, we see an HP smartphone appear in a GLBenchmark list of test results.

Codenamed Bender, the device is running Android 4.0.4 Ice Cream Sandwich. It is also packing a 1.5GHz Qualcomm Snapdragon processor and a screen resolution of 1366 x 720.

It is possible that HP is simply testing the platform for other applications, and this information is not enough to draw a complete conclusion. It may also be an indication that HP intends to join the Android platform and have that OS pick up where webOS was handed its hat and kicked to the curb. The latter seems more likely now that webOS is open-source and being spun off as a separate company called Gram.

HP has never enjoyed wide commercial success with its mobile handsets, although some have been capable devices during their era, such as the iPAQ 600 and iPAQ Glisten. Their half-hearted attempt to leverage the wonderful webOS platform was cut short before it even got off the ground. No doubt, there are some webOS purists that would be disappointed to learn that it looks like the breakup is forever.

I'm guessing they weren't completely ready then?
I had a feeling that the constant switching for best signal might be a problem.
If they get back in the business, it's either Android or WP8. There is no way they would be dumb enough to go with their own OS again.

It seems they're leaning to Android, but since they have a close relationship with Microsoft, I could see WP8. Either way this means we will get a potentially HIGH-END business phone, potentially with a slider or portrait qwerty or both that isn't BlackBerry.

Pairing with M$ works benefit both because they could get great phones and tablets, but this time without a crappy OS.

I think my Droid Bionic's battery is crapping out or the game I was playing a lot (Free Flow) was chewing up the battery. I have another 8 months left before I can upgrade, but I was thinking of using an upgrade from another line to get the Galaxy S3. I'm annoyed in how the Bionic has been terrible with the support it's gotten. I'm still on Gingerbread, Ice Cream Sandwich is supposed to come by the end of the month (though who knows) while the S3 is getting Jelly Bean in October. I don't dislike the Bionic, it's just gotten the short end of the stick by Motorola and Verizon when it was championed as their top of the line phone a year ago when it came out. It's even been discontinued now. Motorola did announce they'd give users of the Bionic-era phones a $100 credit towards the Razr Maxx and other new phones if they don't receive Jelly Bean. It's tempting to wait for except for the fact that you know they won't follow through on it until the Razr Maxx et al are about to be replaced by something new. I feel like trying Samsung or HTC for my next phone instead.

BlackBerry 10 Devices: 10 Things We're Looking Forward To

Windows Phone 8 is RTM: Now in the Hands of Manufacturers and Carriers

Quote:
While it is far from being in the clear, Microsoft has signed off on Windows Phone 8 for RTM. This means that the software is ready to be integrated by the phone makers into their devices.

Certainly this is welcome event, but the journey is not over yet. Earlier this week, we shared in detail some reported problems with the scheduled completion of this task by Microsoft. The manufacturers have to integrate, test and certify their devices for release – with each carrier. Carriers like Verizon are notorious for having stringent testing regimens for new hardware. In all cases though, there is very little time to get everything ready if there is to be an early November launch for Windows Phone 8

Here is to a smooth implementation by the OEMs and good performance evaluations by the carriers.
Microsoft Granted Patent for "Whacking It Off"

Quote:
Before you get the wrong idea, this patent is for silencing your device by whacking it. It is a rather odd way of conveying the meaning though. Once you understand the details, it is an excellent idea. It is based on the premise that there is a desire to quickly control a device without having to interact with it.

Imagine you are at school, in the library or at a business meeting, and your phone rings because you forgot to silence it. The phone continues to make a racket while you pull it out of its pouch, pocket or holster and you turn it off. Using this whack-it-off (or whack-it…there is just no good way to write it) feature, you would just have to literally whack the device (as in hit it) to silence it. This would come in handy as you would not have to handle the phone to accomplish the task. It could remain in your pocket, purse or holster.

When it comes down to it, it is really just a way to use an accelerometer to trigger action quickly. The device rings, a “whack based” component receives accelerometer data indicating a “whack” and the ringing is suspended. In theory, the action would not have to stop at merely silencing the ringer. Perhaps it can also initiate sending an appropriate message to the caller.

In their patent text, Microsoft provides 26 ways to whack the device, including instances where multiple whacks may be used (seriously, we are not making this up). This technology could be deployed across different types of devices as well.

Since the patent application was just published, we do not expect to see this feature right away. When it does arrive however, just be sure to take it easy.
Verizon's Samsung GALAXY Nexus No Longer Supports Google Wallet

Quote:
Those rockin' Verizon's version of the Samsung GALAXY Nexus and have been using Google Wallet after sideloading it onto their device, might have had a surprise when they tried to open up Google Wallet on Friday. A little message said that "This version of Google Wallet is no longer supported." That can't be terribly surprising considering that Verizon never officially supported the application (hence the reason for sideloading it on the phone), and the mobile operator is one of the trio of carriers that is behind competitor ISIS. Just when things had finally been looking up for Google Wallet, with usage doubling in recent weeks, the news leaves Sprint as the only carrier really putting any effort into the application. But that is something that can not be counted on forever since Sprint has its own mobile payment system that it is working on.

Just like the dinosaurs in Jurassic Park had to use frog DNA to reproduce, life finds a way. In other words, we wouldn't be surprised to see some type of workaround from the developer community. In the meantime, we guess for those Verizon customers with the Samsung GALAXY Nexus, it's back to using real cash or plastic credit cards to make purchases.
