Not true. That is a state issue, not national, and each state has its own laws pretaining to that. For instance, in Texas, they only have to be on your property, not even in your house anymore. If you feel threatened you can shoot to kill. In Texas though, it is still common knowledge that you really want them in your home. Once in your home, there is no need of showing them the door. "I told him I was going to shoot so he needed to leave, he didn't so I shot him" how are you going to prove that you said that if it was only you and the intruder? And in most states it would be manslaughter, not murder.

Either way, I read somewhere that if it was dark and he couldn't see the "intruder" clearly, he should have aimed for center mass. The head is a relatively poor target. If she was shot in the head, he either got very very "lucky," or it could be argued he saw her well enough to recognize her.

It still is because it seemed like they lived together (I could be wrong). I sometimes come home from work late (3am), and my fiancé is never waiting for me with the crowbar in his hands because he thought I was an intruder.
