I see country-wide gay marriage as fairly inevitable. But if they have to go state-by-state, it's going to take a while.

Some states (basically those in the Bible Belt) will never legalize it, so that's going to take a later date court action. So give it five, maybe ten years.

I really wouldn't compare two guys getting hitched to killing a fetus.

One is going to be more hot button than the other, for obvious reasons.

Once you get past homophobia, there really isn't much of an argument to be made against same-sex marriage. At least not one that would hold up in court.

Again, punting it based on lack of standing doesn't make it a STATE BY STATE issue. It makes it a CIRCUIT BY CIRCUIT issue. Not many people understand the distinction. Plus that would make it very....fluid. The Court of Appeals does not have the same respect for its own precedent that SCOTUS has. Stare decisis isn't really a concept that exists in the Court of Appeals. Ten years may be generous when dealing with the Court of Appeals.

And with age comes loss of flexibility and often a "set in their ways" stance. Age may bring wisdom but that doesn't mean it brings rationality. I can have my opinion they can have there's. I do not for see the same uproar. Regardless of their opinion or yours.

No opinion is greater. Their's just unfortunately carries more weight

I do not mean to imply that my opinion is somehow better, but at the same time, don't you think there is a bit more weight to the opinion of someone with a J.D. weighing in on a legal history, compared to that of a layperson? In terms of understanding legal history, trends, effects, etc....one with a J.D. is better equipped to analyze these issues (and I am not necessarily speaking of myself, but instead basically every analyst, Justice, judge, etc who is saying almost the exact same thing).

That's not exactly what I was trying to say. Regardless of what this court does, more and more states are going to legalize it by popular vote or through legislation. We've seen that in multiple states now.

New Jersey, Oregon, Hawaii, Delaware, Illinois and Rhode Island will all legalize it regardless of this ruling in the next few years.

Once you have that much momentum, it's inevitable. Except you know, in the South.

You can way in on legality. But that's not exactly the same world as social psychology

But the thing is, if it is punted....the Court of Appeals in each circuit will have carte blanche to make their own law. SCOTUS will essentially be saying that the Ninth Circuit acted within the scope of its power by overturning California's constitutional amendment (without actually saying that or that the California ruling was right). In essence, EVERY Court of Appeals can then overturn any state law passed on the issue in the states that are in their jurisdiction. See the conundrum of the circuit split?
