Commonwealth Court says rejecting mail-in ballots without a date violates the Pa. Constitution • Pennsylvania Capital-Star
In a decision likely to be appealed, a Pennsylvania court ruled counties can't reject ballots that are returned on time but without a date.penncapital-star.com
People who vote on Election Day don’t have this requirement, why should mail voters? It’s fundamentally unfair and unequal and ultimately a pointless requirement that disenfranchises voters - as the court majority points out. Some counties have ended up contacting voters to fix their envelopes anyway over this bunch of nothing requirement. The date the counties receive the ballots is what’s important as there is a deadline.
Maybe some things are just too blatant to be excused.![]()
Federal Court Rules PA's Date Requirement For Mail-In Ballots Violates First and 14th Amendments
Decision means PA counties cannot reject ballots from counting undated and wrongly dated mail-in ballotswww.politicspa.com
The surprise here is that it’s a Trump-appointed judge who ruled against the requirement.
