Mr. Birkhead, a freelance photographer from California, was clearly elated about the ruling.
"My babys going to be coming home pretty soon, he said before television cameras outside the courtroom. He was asked what Ms. Smith would have thought of todays ruling.
I think she would have been proud that I fought, he said.
The baby has been in the custody of Mr. Stern, living in the house in the Bahamas he shared with Ms. Smith. Mr. Stern, who was also at the hearing, emerged from the courthouse and said he would not fight the decision declaring Mr. Birkhead the father.
My feelings for Dannielynn have not changed, Mr. Stern said. I am not going to fight Larry Birkhead for custody. Im going to do whatever I can do to make sure he gets sole custody.
The infant daughter stands to inherit millions of dollars from the estate of Ms. Smith, who was involved in litigation over whether she would share in the inheritance of her former husband, J. Howard Marshall II, a Texas oil billionaire who died in 1995.
