Well, TDK would remain largely the same, I would have either cut out the Two-Face subplot at the end, and end the film with Two-Face walking into the bar and saying "half..."
I don't know if I would have liked it. Seems like too much of a cliffhanger to have to wait four years to see the rest of the scene. If I were to cut the Two-Face subplot, I would drop it around the time that Joker blows up the hospital and he goes missing. Then the rest of the film proceeds as it did, but without the Two-Face scenes, thus ending after Batman and Joker's battle at the Prewitt Building and their conversation afterward.
Or I would have kept it similar, but instead of Two-Face being dead, have Bats and Gordon agree to lock Harvey up, secretly, and try to rehabilitate him while letting Bats take the fall for what Harvey did. And then go into how Harvey continues to deteriorate in lockup, eventually escaping..
Hell no. That is illegal in America, and would be the ultimate betrayal of their ideals of justice if Harvey Dent is incarcerated without due process, and that the Joker won by making them break their principles.
