The thing about those two composers is that they're sticklers to using L.A. union musicians for their film scores. Marvel Studios doesn't want to pay residuals or re-use fees for potential soundtrack releases, they prefer the buyout option for scores recorded in London or Seattle.

It's safe to say Tyler Bates will be doing Guardians of the Galaxy. He's not a stickler for where the score is recorded, and James Gunn is fond of him. So unless Marvel wants a more appealing sound, Bates will probably be doing the film.
