Guys Breaks Into House, Calls 911 Afraid Homeowner Might Be Armed

A man who broke into a house in Portland, Oregon, called police -- afraid the homeowner may have a gun.

The suspect, Timothy James Chapek, was in the bathroom taking a shower when the homeowner returned to the house Monday night, Portland police said in a statement.

Accompanied by two German shepherds, the homeowner asked Chapek what he was doing in the house.
Chapek locked himself in the bathroom and made an emergency call, police said. He said he had broken into the house, the owner had come home, and that he was concerned the owner might have a gun.
The homeowner also called the police to report that he had found a man in the house.

Police with dogs took Chapek, 24, into custody "without incident," they said. He was booked for criminal trespass.
They did not say if the homeowner did in fact have a gun.

Isn't the whole justice system a mess anyway? Isn't it something like if you attack someone who broke into your house from behind you can be charged and can't use self defence in your defence? But if they are facing you, you can?

If I find someone breaking into my house, odds are I'll kick em in the back with some buckshot, or at least the kneecaps. If you break in, I don't recognize you, then your life and dignity are forfeit. In that exact order.

Why would you shoot some kid before he called the cops on himself?

Yeah, some homeless people have cell phones because 911 is free to call.
 
I came to comment on how ridiculous this story is, and then I got distracted by the awesome Bill Cosby avatar...
 
Reminds of an article I read once where some dude steals a car, drives off and then gets lost so calls the cops on himself. :wall:

pretty much. in most states, the only way you can use any type of force on an intruder is if you're backed into a corner with nowhere to go and you are literally fearful for your life. Anything other than that, they'll tell you that you should have ran out the door and charge you with assault.
