purchase beer but not have an id?

i.e. im a 19 year old, no id, and i try to buy beer with the hopes i dont get asked for an id.

IF i get asked for an id and dont have one, can i be arrested?

my bro thinks you cant and i think you can, whose right?
 
I don't know if you can be arrested, but you won't be...

And 19? Jesus Christ, you should know how to get your hands on alcohol by now.

Every town has that one store that doesn't ask. Find said store and enjoy.

However, to answer your question.. I never got arrested.

21 years old is the minimum age you can purchase or buy alcohol in the US. It's not a state by state thing, but a law for the entire country.

So yes, if they wanted to, they could arrest you for purchasing under age, and probably slap on the charge of trying to get alcohol for another minor.
 
thats not point. what i am saying is-

would it be illegal to just tell the cops you left your id at home, or plea the 5th, and then just leave?
 
No, if you don't have an I.D. (as opposed to handing him a fake) all he will do is say "sorry, I can't sell you this without an I.D.".
 
You can't be arrested for drinking under age, but you can be arrested for purchasing, or the public possession of, alcohol. And the store owner can be charged with selling to a minor. That's why their supposed to card everyone they think is underage, and a number of places card everyone.
 
Here's some stuff about Mass. laws and drinking.

2. Purchasing Alcohol

A. For persons under 21 years of age:

A person over 21 years of age may not buy alcohol for a person under 21 years of age, unless their relationship is that of parent and child or husband and wife, and even in those situations liquor must be bought at a package liquor store, not a restaurant or tavern. Violation of this section may result in a fine of $2,000, imprisonment up to 6 months, or both. M.G.L.c.138, #34.

B. By persons under 21 years of age:

Alcohol may not be purchased or attempted to be purchased by a person under 21 years of age. A person may not lie about his/her age to purchase alcohol, present false identification, or make arrangements with someone older to buy alcohol for him / her. Violation of this section may result in a fine of $300. M.G.L.c.138, #34A

C. Liquor purchasing ID cards:

Any person who transfers, alters, or defaces any such card, or who makes, uses, carries, sells, or distributes a false identification card, or furnishes false information in obtaining such a card, shall be guilty of a misdemeanor. Such persons are subject to immediate arrest. M.G.L. c. 138, #34B.

I know... I live 2 and a half hours away from Canada :up:, and I'm 19.

Pretty much from the time I turned 17 I would just walk in a package store and buy beer. No one asked for any ID... no one cared. The other day I got carded, and I was thinking how that never happened when I was underraged.
 
That excitement of buying **** as a minor will wear off eventually.

yup... it alternates between every landmass province.
 
I don't see how they could arrest you. This is how it should go:

You: "Hey man, how's it going?"

Clerk: "Good. Just the beer for you?"

You: "Yeah."

Clerk: "Do you have your ID on you?"

You: "Uhh... uhh... sh_t. No, man, sorry."

Clerk: "Sorry, buddy, I can't sell you the beer."

Then you leave and go on with your life.
