Sequels Question about characters

    I have a question, if someone can answer it that would be great

    If both studios Marvel and Fox have the rights to Quicksilver and the Scarlet Witch because they have both been in the Avengers and in the X-Men, then what is stopping Marvel from using other characters that have been part of the Avengers like Spidey, Wolverine, Beast, Namor, the FF, Sandman, and Storm

    They have all been in the Avengers' roster. Also could Fox use Ms. Marvel?

    So far, Wanda and Pietro are the only ones we know who exist in a legal limbo, that likely only came about when Fox/Singer wasn't sure he wanted to introduce them into the X-Men movies way back when. There's still a possibility that there might be some other "floaters" out there that can legally dual-exist in separate movie universes, but we haven't heard of them yet.

    Also, gotta keep in mind that these legal rights were signed way back in the 90s and Ms Marvel wasn't even involved with the Fantastic Four back then.

    I'm sure Fox and Sony each have a long list of characters they can use. And Marvel has a very short list of characters they can share.

    As said before, it's not really based on who appeared where, it's based on the contracts signed back in the 90s when Marvel was in money trouble. There were lists of characters, generally ones we'd expect to go together. Spider-Man came with all his villains and supporting cast. FF with theirs. X-Men with pretty much all the mutants except, so far as we know, three: Dazzler, Quicksilver, and Scarlet Witch, those last two were on a very short list of 'either can use them.' We don't know who else was on that list, but it can't be many. I suspect we'd see mutants like Justice and Firestar and Squirrel Girl on there, and not much more.

    Well Dazzler was originally created just as a property to sell music like the cartoon Jem, but disco died and so did the idea.
    I still think Quicksilver and Scarlet Witch are more Avengers than Xmen and FOX/Singer over stepped by assuming they could use the characters just because they're mutants.

    I can see Hellcat/Tigera, Spider-Woman (Jessica), She-Hulk, Clea in Avengers as well

    Can anyone explain why Dazzler is in a joint rights, shes not an Avenger and was always strictly an X-men character? I mean it would make more sense for Beast to be shared due to the fact that he has a lot of history with the Avengers.

    One more question though, Where would the new mutants appearing now in the comics fall? I mean they are characters that were not created back when the rights were signed off to Fox. Would there be an assumption that future characters associated with the X-Men belong to Fox for their big screen appearances or could Marvel include them in a wider MU movie.

    Other kinda big characters that were not created until after the rights deal are

    X-23 for example was not created until 2003 I think
    Dust in 2002
    Pixie and Surge 2004
    Rockslide 2003
    Even the Stepford Cuckoos only appeared for the first time in the early 2000's

    Would marvel be able to use them?

    Fox can use them because they're mutants, not necessarily because they've been in X-Men comics (which they haven't a whole lot). Marvel can use them because they're full out Avengers characters. Other characters like Beat and Wolverine don't count because they clearly fall into line with X-Men comics, while Pietro and Wanda don't. It's that simple.

    Any and all mutants go to Fox.

    Daz didn't start out as an X-man. She was simply someone who could change sound into light and teamed up alot. See like I said Dazzler was a different type of Property for Marvel, they created her for actual LIVE concerts and it fell through.
    It was sort of the same idea as G.I.Joe, Thundercats, Rom and Micronauts but instead of toys aimed at boys, it was a female disco star for the girls.
    There's more to Dazzler than just being a mutant

    I think they made a specific exemption for scarlet witch and quicksilver because they have been such prominent avengers. The other xmen who happen to have been avengers don't get the same rights

    Beast has a big enough presence in the classic Avengers to have a case for crossovers; but I doubt either Marvel Studios or Fox are interested in pursuing that avenue.
