It's been pretty much confirmed, it's just a little controversial because it's also been reported that he does NOT wear the mask. So it's basically just Crane.

I dont think it has been confirmed or denied that he wears the mask at one point or not. He could judge while maskless then execute with the mask on.

What I was hoping for, similar to a judge wearing a black cap when handing out a death sentence.

Crane's cameo in TDK served a purpose. I have no doubt regardless whether or not he appears in Mask or not. I'm sure Nolan made Crane's cameo in TDKR just as good if not better.

Its pretty much not going to happen but imagine if scarcrow fear gas'd bane and he just continued to see the world as normal.

I think there was a comic like that a while back where he fear toxins the joker and the joker just see's the world as he normally see's it.

Well I recieved my copy of the TDK trilogy book and it directly addresses all of this. If you want to know,

There are 3 pictures of Crane as the judge of the court in TDKR. His suit is really torn up and he has a bit of stubble on his face. No mask in any of the pictures, but he is wearing his trademark BB glasses. I'll try to post scans later if I have time.

If I had to venture a guess as to why he might appear without his mask, perhaps it's because it was taken from him in TDK by batman during their encounter.

I was watching THE DARK KNIGHT last night...and Murphy was just awful as Scarecrow. Its like he didn't even care that he was in the movie, so he didn't bother to play the character. If he shows up in THE DARK KNIGHT RISES, I hope he's at least somewhat into it.
