Teen Spends $750 on an Xbox One Photo, Gets What He Paid For

A teen dad is pissed after spending some $750 on what he thought was an Xbox One console for his four-year-old son, only to receive a photo of an Xbox One instead.
Peter Clatworthy, of Bilborough, England, jumped at the opportunity to purchase an XBox One Day One edition console for £458 from what looked like a reputable eBay seller.
The 19-year-old acknowledges that the item was specifically marketed as a "photo," but says the category it was listed under — video games and consoles — convinced him it was legit.
"I looked at the seller's feedback and there was nothing negative," he told the Nottingham Post. "I bought it there and then because I thought it was a good deal. It's obvious now I've been conned out of my money."
eBay agreed: It has ordered the seller to return the money to Clatworthy by Monday.
Though the Xbox was officially released in the UK and elsewhere on November 22, many have taken to eBay in the hopes of purchasing a Day One edition, which was reserved for first-day buyers.
As a result, eBay has been flooded with scam artists looking to pass off empty boxes as the real deal.
If it makes Clatworthy feel better, the Post reports it had stumbled upon a popular listing for "XBox One Day One edition retail packaging."
At the time of writing, there were 80 bid on the item — the highest being £7,200 ($11755).

Well at least he should get his money back but the listing did say photo so I don't see where Ebay gets off saying he should get his money back
 
The guy's a fool, and not just for having a child at 15 in a OECD country, but the seller knew what he was doing, and it was a dick, scammer move.
 
This guy shouldn't get his money back. He needs to know not to trust people and that's the lesson he needs to have learned.

This is the dumbest story I have ever heard.

The guy should get a refund, but DAMN man, read the description before you drop 750 dollars on anything. Unless you are...

the seller is the one that broke the law. why should the victim take the brunt of it?

Because the victim is a dumbass. And dumbassery must be punished or it shall be repeated.

I frankly don't think it should be against the law. It's stated that it's a photo in the description. He should have known what he was paying for, and it's his problem if he didn't. A fool and his money and all that.
 
I hate that he got tricked, but I mean if it's in the description I don't possibly see how that's scamming. Outsmarting sure, but you get what you pay for.
 
Ya people do this gimmick in America all the time and usually get away with it, Ebay can tell him to give the money back all they want it doesn't mean he has to do it. If anything he will get a negative on his account and he could just start another one if he wants

Don't know if it breaks the law, but if they listed it under electronics or "Video Games & Consoles" it might be false advertisement.

And if the word photo is dropped in like this it's a bit misleading

The buyer should read & look carefully at the item/s he's buying. As the saying goes, "caveat emptor".

This guy just looks like an idiot, but the "seller" is a dick too and should give him his money back.
 
I just love his stupid face-saving excuse that he was buying a fairly hardcore and mature FPS/RPG-centered gaming console for his four year old and the paper reported that as fact. Dude, you just gave someone over seven hundred dollars for a photograph like a chump, and you're really going to lie about who it's for?? You'd think he'd have much bigger things to be embarrassed about.
