Is this real ? I wish there were 6 inch figures available.

It's real in that it exists, yes. Not official, licensed products though. Toy Era make unofficial figures at a pretty high quality (from what I can see). "The Mystery" is their fake name for Mystique. They previously released Erik under the guise of Magnant.

They get away with that? I mean looking at that illustration I'd say it counts as more than just a very close resemblance!

Yeah they seem to get by. I guess the projects are small scale enough not to hit Fox's radar. There is no official alternative to compete with, so it won't harm any of their profits.

Disney/Marvel controls the merchandising for the X-Men franchise.

It's satisfying for fanboy since we do not have many figures that come out of this franchise.

marvel wants xmen to fail, so no action figures

Nah Marvel/Hasbro has been slowly releasing X-men figures. Not movie figures, mind you, but it's a start. And the X-men Marvel Legends line are fairly popular, where whole lines of non X-men ones are mere peg warmers. Marvel is finding out that X-men fans have been craving their toys.

But seeing the disparity in quality of their Marvel Legends movie figures to their Marvel Legends comic book figures (Spidey and Captain America movie figures are horrid compared to their comic book figure counterparts), maybe we're not missing out on much.

Wouldn't mind seeing what X-men Hot Toys would look like though, and not just Wolverine.

Marvel signed off on a multi-program X-Men television production deal with FOX. Legion aired to great reviews and Gifted is a lock for the fall schedule. If Marvel wants the franchise to fail they are doing a terrible job.
