New law restricts re-sale of kid's products

08:53 AM CST on Wednesday, January 7, 2009

By SHELTON GREEN / KVUE News

A new federal law is raising concerns and questions nationwide and here in Austin.

On February 10, 2009 it will be illegal to re-sell any used children's products including toys and clothing. That is according to the U.S. Consumer Protection & Safety Commission who pushed for the new laws after dozens of toys were recalled in 2008 because of lead concerns.

Toys, clothing and other items used by children under 12 will be subjected to lead testing and will have to have labels on them to prove that they have passed inspection.

What is raising the ire of parents and business owners far and wide is what this will mean to clothing, toys and other children products made before February 10, 2009.

Gary Walthall, the owner of Once upon a Child, a resale shop specializing in children's clothing and other items, is afraid that he'll have to close up shop.

Adding to the confusion and frustration is the fact that the U.S. Consumer Products and Safety Commission is not returning calls or e-mails to the countless re-salers and even journalists who have tried in vain to get clarification on what the law means to garage sales and how it will be enforced.

this should be interesting to watch:whatever:

How about antique stores and toy shows? They going get busted?

Prohibiting sale of old toys and clothes is ******ed. Sorry but that will not fix the problem caused my manufacturing companies. That's who they should go after.

The police are going to launch raids on yard sales

Remember Kids, Government is here only because they are smarter than you and should tell you how to live. If you don't, you are a Criminal.

Did they Government just outlaw Recycling of certain items?

OK so there's possible lead in toys, but what about clothes? I have heard of small recalls of certain types of clothes, mainly small parts like buttons coming off(choking hazard for infants/toddlers), but I can't recall ones with lead inside them. I suppose maybe in the metal parts. I just can't imagine a nine year old boy sucking on his zipper so why not just ban up to 3-4 years.

I wonder if gimps do that.

If you are referring to kids with a mental disability then yes I thought of that but that would only be a very small percentage of kids so you wouldn't think they would put a ban across the board. However they have banned nuts from school now for another small percentage, so maybe.

While I wonder about the clothing, with what happened last year about the lead in toys, I'm all for tougher restrictions about the quality of children's toys

No, I was NOT referring to kids with a mental disability. Jesus. I was referring to the people who wear bondage masks with zippers across the mouths. It was meant to be a joke..

And you just overreacted for no reason. I wasn't criticizing you, I just prefer not referring to children with disabilities as gimps, ******s, or whatnot that's all.

But he didn't refer to them as "gimps, ******s, or whatnot"

Thank you. I didn't refer to them at all in fact, until he brought them up.

My apologies, I misunderstood since the topic was about children's toys and clothes and I was talking about children's clothes.

In any case, for the government to do this with economy in such bad shape, I would anticipate the closure of many small businesses.

looks like big brother does not want the average american to make some extra money on the side during these times of economical stress
but then again, here in Mexico, used car prices shot down, and the taxes to own them increased 300%

how odd, aint' it?

Here in a Couple of States, Politicians what a Milege Tax instead of a Gas Tax. To Enforce it, they will have to require all Cars to have GPS installed, and they will track how much, and WHERE you drive, then send you a Tax bill. That's not scary at all, is it?

This is nothing more than the Government seeing just how much more power they can take, they do it in the Name of "the Children", but in doing so, it takes away Liberty and Property away from this country's Citizens.
