Looks like it is happening. It was announced with Van Damme/Seagal, but that wasn't happening so now it's VD/VJ with the director....of Highlander, Highlander 2, and Resident Evil: Extinction. He has the upcoming Give Em Hell, Malone with Thomas Jane and Ving Rhames, too.

It's being shot in Vancouver later in the year. This *could* be picked up by any studio and goes to theaters if the end result is good.
 
There's way too much bad blood between Van Damme and Seagal for it to happen. At least Mulchahy might guarantee a theatrical release for Van Damme. Which he desperately needs.

JCVD went to theaters, but it was limited. In fact, Muclhahy says in the links above that he saw JCVD and was impressed with his acting. Which is why he is doing the movie. From what I understand, the movie is having pre-sales at Cannes in the upcoming days.

JCVD did over $470,000 in US theaters, although very limited release. Weapon is gonna be his next shot in theaters if the new Universal Soldier movie doesn't hit theaters. (Although with Van Damme and Dolph Lundgren in it, it should be a hit on dvd anyway. That movie is in post-production now and Sony has the rights. But Dolp did like 3-5 days shooting and Van Damme only did 10-30 days shooting on it.)
 
Actually UniSol 3 is getting a limited release too. About 600 theatres I think. But I'm hoping for a wide release.

With UniSol, I believe it when I see it. But the early proof is that it's got some buzz. And two pics were officially released to sites, one of which was Dolph and Van Damme together.

And it wouldn't be a big risk. The budget is suppose to be in the 10-25 mil range.
