Ever hear the phrase "great minds think alike". So they're not "great" minds, bout they are really really really good at what they do. I think this applies here.
Is it so hard to believe that two people came up with a similar joke? This happens to writers, inventors, musicians, and filmmakers all the time.
Accept it or not...even if thats the case, Dane has better delivery.

He does, just like Carlos Mencia. When confronted by Joe Rogan, Dane Cook was another one brought up who steals material. There is a video out there somewhere, forgot where I saw it. But Rogan eats Mencia alive, and somewhere along there Cook gets mentioned as well.
