Just from quicky scanning the artcle it looks as though the judge was trying to prevent him from landing in the sex offender registry. I know we hypesters had quite the debate on the efficacy of the sex offender list. This story might be more fuel for those who want to get rid of it.

OTOH, since this guy had already picked up the nickname "David the rapist" even before assaulting the two girls at the party, perhaps he ought to be on some list.

The registery as it exists is worthless. The idea behind it is sound however. It's just like everything else that politicians touch. They take otherwise good ideas and dilute them in the name of gaining votes whether or not their implementation of a law actually does anything.

This case is another one where the judge should be sanctioned in some way for failing at law.

This reminds me of a college football player I saw a video about once, he got charged for drunk driving and was held into custody for quite some time for it.
