Man Jailed for Yawning.

Wow, this is...not even funny. I would be ****ing screwing. I'd give them a real reason to lock me up.
 
I get out i'm suing the judge.

Might not do anything but its the principle.

He got more jail time than his cousin who was selling drugs on a felony.

The only reason I could see the judge doing that is if the guy KEPT doing that over and over again. I thought that the judge had to, at least, give a warning before he could just sentence someone for contempt of court.

It just sounds like a lot is left out of the story or this is just another example of a person that shouldn't be in that kind of position of power.
 
Even so, if the guy had been yawning over and over again after being asked to stop, a six month sentence is way too harsh.
 
Yeah, but we weren't in the courtroom with the other people. For all we know the guy could have been yawning REALLY REALLY loud over and over. One thing people should know, if you've been in trouble with the law, is to never piss off the judge.

There's gotta be something. "Cruel and unusual punishment"? That has to cover this somewhere in the constitution. This is the equivalent of whipping a woman for exposing her face in arab countries.

He wasnt in trouble with the law. The guy was just in the courtroom chilling waiting for his cousin to get sentenced. He was just a random dude. Who yawned.
 
This is funny...but it also makes me a little angry. THat is ridiculous. If that judge can send you to jail for yawning...exactly what do you have to do to get a life sentence? :dry:

He shouldn't be a judge.
 
This is the same country that won't allow DNA tests in some murder trials, and sentences child molesters and attempted murderers directly to probation. But yawning in the courtroom? You deserve to go to jail for being bored in court, damn it!

You'd be hard pressed to find an appellate court that would consider six months for contempt to be cruel and unusual punishment. If the court agrees that it is, then it potentially means that all contempt cases punished with a six month sentence are cruel and unusual. The court has to look at the individual case and the law at hand... and as stupid as the sentence was, they're not going to change the law or strike it down based on this one instance...

I realize that. I was saying if you've ever been in trouble with the law you don't piss off the judge. I have been in security for like six years now and I have to appear at court on occasions. Trust me...about 99.9 percent of the time when people get in trouble like that they ask for it by being difficult.

For all we know the guy could have kept yawning and interrupting the judge through the whole sentencing. Or maybe he wasn't. It's still stupid either way. :cwink:
 
All he has to do is apologize to the judge and he is out...

To put perspective on the situation. I was in court recently and the defendant's mother called the judge: "a worthless, dickless, ignorant piece of ****"

She was held in contempt for 24 hours.

That dude must have been yawning really loudly.

I respect the judge's decision because he's the judge and that's what he does, but I think no matter which why you slice it yawning alone shouldn't be reason for 6 months.

Hopefully the guy was being rude and disrupting in another way altogether.
 
He was probably being a smartass. The article read something like, "as his cousin was being sentenced..."

So I can see him yawning once really loud to show some sort of rebellion towards the judge's rulling.

But at the same time, this same judge also puts people in contempt who are not trying to be rude. So I can see him being the mean old teacher at school who does anything he can to get the kids in trouble because he's in that postion of power.

Either way, 6 months!!!

Even if the guy was being a jerk, I don't see how that judge sleeps at night.
