Ah ha! He just sent me 2 screen caps and I asked him if he's sure it wasn't Modine. They kind of look similar from far away. False alarm, I'm leaning towards Modine. I don't think this guy was trying to fool anyone though, it does look like Eckhart (but it's probably Modine).

Based on this screen cap I can see how he got them mixed up. He kept calling it "Batman 3" in his emails to me, so he's not a die hard fan like us. I asked him if I can post the screen cap so you guys can see. Modine makes more sense, I think we were all just hoping it was Eckhart.

I think so too. If Eckhart were to be in TDKR I'd imagine it'd be footage of an old news broadcast or a very isolated flashback of sorts... can't think of why they'd need to film a scene of him and Gordon, wouldn't give any new information unless it was set in the present, which is very unlikely.
