PORTLAND, Ore. - Two provisions of the USA Patriot Act are unconstitutional because they allow search warrants to be issued without a showing of probable cause, a federal judge ruled Wednesday.

U.S. District Judge Ann Aiken ruled that the Foreign Intelligence Surveillance Act, as amended by the Patriot Act, "now permits the executive branch of government to conduct surveillance and searches of American citizens without satisfying the probable cause requirements of the Fourth Amendment."

Portland attorney Brandon Mayfield sought the ruling in a lawsuit against the federal government after he was mistakenly linked by the FBI to the Madrid train bombings that killed 191 people in 2004.

The Patriot Act greatly expanded the authority of law enforcers to investigate suspected acts of terrorism, both domestically and abroad.

They only found TWO unconstitutional items?!!?!? Well, it's a start.

Ellerby wont approve

Patriot Act, Patriot Act! I love it, I love it, I love it!

Now to have someone challenge the rest

Anyone that knows their history can draw parallels to how Germany became a police state after Hitler came to power. After the Reichstag fire in '33 (which many thought were either deliberate or previously known about by the government, closely paralleling common concepts concerning our government and its knowledge of 9/11), they blamed it on the Jews (or in our case, the terrorists) and began suspending civil liberties. Now we are nowhere NEAR where and what Germany was during that time, but the Patriot Act is in itself a slow elimination of civil liberties. It goes to show that many things have similar beginnings.

now we'll never stop those damn terrorists! :(

Roman history and bible stories share similar elements as well. The more things change the more they stay the same.

I guess they messed with the wrong attorney.:woot:

Brandon, we're really sorry about the whole train bombing accusation thing.

Nazi Germany didn't start out as Nazi Germany, it started out as the Democracy of Weimar.

I'd say it was created by a good knowledge of history... :word:

Well I'm sure that those in power that have hijacked America and its Government have studied the mistakes of the Nazi regime and will not be as blatant in its quest for global hegemony.

I agree. If America doesn't follow the same mistakes Germany made then the goals Germany set out for itself can be achieved by the US.
