I have never done anything like this before but I was curious about how the State Department regards the FS-240, what it does for those who have it and what justification they had for their stance. I don't even know if this is an appropriate request but **** it I sent the following and requested it to be expedited with fee waived due to public interest. Without further ado here is my request:
My Questions are in regards to Consular Report of Birth Abroad(FS-240) and the laws that empower it; my questions are as followed:
1) According to the State Department; does the failure to attain an FS-240 before 18, permanently prevent a person born outside of US Jurisdiction, from ever attaining the status of a "Natural Born" citizen of the USA? (This is assuming a scenario where at least one of the subject's parents was a citizen of the USA at the time of the subject's birth and the subject who failed to obtain an FS-240 before 18 became a citizen through one of the naturalization processes later in life)
2) For that matter, does the FS-240 even grant a US citizen born outside of US Jurisdiction the status of a "natural born" citizen of the USA according to the State Department, or is it considered another form of naturalization process?
3) If attaining an FS-240 does grant a citizen born outside of US Jurisdiction the status of a "Natural Born" citizen of the USA according to the State Department; then which Acts, Laws or Court Decisions grants "Natural Born" status under that scenario or otherwise empower the State Department to grant "Natural Born" status to anyone? (The only immigration act to contain the "Natural Born" language is The Immigration act of 1790 and it was superseded by and repealed by The Immigration act of 1795)
