He was, but he's been outed numerous times in the comics. It's extremely unlikely for numerous reasons that Civil War will ever make its way onto celluloid.Wonder if that was one idea why Stark said he was Iron Man in the film? Wasn't he the first to "come out" before the War?
Again, I would... in a very quick cameo spot, like Spiderman swinging off in the distance and Stark saying, "I wonder just exactly who that is".
Cap saying, "Lets go Tony, we will look into that later, we got more important issues at hand for the moment".
Stark still gazing in the distance at a swinging Spiderman with an intriging tone saying, "hmm.... yeah". Than takes off with the rest of the team.
A quick 20 second scene just to acknowledge the same time continuity.

Since when has that mattered? For all we know, the events of Iron Man & TIH could've been a good year or more apart. Other than that, the movies have always existed independently from one another & that's ok. We didn't see Lady Liberty with a big gaping hole in her head in any Marvel film other than the one in which it happened. Blade didn't look in his rearview mirror someplace & see Ghost Rider. Like I said, some things are just nice bones to throw but really can't be done & shouldn't be dwelled on.
