No way. Sony has too much money in this thing to let Marvel take it back.
But Sony just has a three picture deal with Marvel. It isn't clear what will happen after the sixth Spider-Man film because it would make no sense for Marvel to have agreed to an in perpetual film rights contract with Sony Pictures when they had Marvel Studios that was fresh off the success of Iron Man and releasing the Incredible Hulk.
Honestly I would see some kind of Sony/Marvel deal as a win-win situation. Sony would benefit from having Spider-Man associate with Iron Man who is a big thing right now and Disney would benefit from having Spider-Man in their film universe (and if the film rights revert after the third film, they wouldn't need to introduce him in their film universe).
So I guess only Fox and Sony have complete control over the Marvel franchises they bought during the 90's right?
In that case it'd be awesome if Sony and Disney could broker a deal to have Spidey in with IM, Thor etc.
Although this is nothing but a gigantic dream.

Sony signed another three picture deal with Marvel in 2008 for Spider-Man. But they have in perpetual rights to Ghost Rider. So honestly, I think that Disney will take them from Sony after Sony makes their sixth Spider-Man film. Why wouldn't they?
20th Century Fox on the other hand has in perpetual rights to all the film characters they own. But at the rate Daredevil is going, the film rights will revert to Disney pretty much any day now, and the same could happen to Fantastic Four if nothing is done as well. X-Men on the other hand will never leave Fox.

Why did Marvel allow this?! Why not take Spidey back when they had the chance?
According to Variety Sony has perpetual rights to Spider-Man as well. As long as Sony keeps making Spider-Man films the rights won't go back to Marvel/Disney.
If thats the case I'd say Spider-Man will never leave Sony either.![]()
Not sure about that. I'm pretty sure I read somewhere that Paramount has distribution rights for these characters until they relinquish (sell the rights).

Wrong. Marvel owns the Hulk rights now; Universal only owns the first Hulk movie. Should Marvel choose to make a Hulk sequel, it will either be distributed by Universal like TIH was or by Disney's production arm.
Marvel developing an in perpetual deal with Sony for Spider-Man nonetheless when Marvel Studios was formed doesn't make any sense. Sure you can't tell if Marvel Studios will be a success in the long term, but if it is, giving Sony a three picture deal gives you the opportunity to take the film rights back and if it isn't you can still keep the franchise going.
Sony claims to have a perpetual deal on Spider-Man but they had to renew the deal in 2008 after making three films, I don't see why Marvel would change that. And the original story did say that the deal was for Spider-Man 4, 5, and 6.
