Driver that struck teen suing dead boys family

Now the driver of the SUV, Sharlene Simon, 42, a mother of three, formerly from Innisfil, is suing the dead boy for the emotional trauma she says she has suffered. She’s also suing the two other boys, as well as the dead boy’s parents, and even his brother, who has since died. She’s also suing the County of Simcoe for failing to maintain the road.

Even the family’s lawyer is in shock.

“In all of my years as a lawyer, I have never seen anyone ever sue a child that they killed,” Barrie lawyer Brian Cameron said. “It’s beyond the pale. I just couldn’t bring myself to tell them on the phone.”

A South Simcoe Police report shows Simon admitted that she was driving at 90 km/h in an 80 km/h zone on the two-lane road. She claims she didn’t see the boys or any of the orange-red pedal reflectors. The impact of the collision cracked the windshield of her SUV, dented the bumper, a headlight was busted, the roof where Brandon hit was dented and scratched and a side mirror dangled by its wires.
Wow, that woman is really ****ed up.

Looks like the lady in question is being sued so she is counter suing, my guess is the counter suit is nothing more then a threat to drop the original case
 
Doesn't matter. Counter-suing the family who lost two kids doesn't make her look good and she won't win.

It's not as much about winning her case it's about the other side not winning theirs.

At first I thought the lady was a b----, but looking further at the case these kids were out at 1:30AM in the morning doing a hotdog run while riding their bikes in the middle of the street and got hit. Now it's a terrible thing that happened but no lawsuit should went up against the lady who hit those kids in the first place, I don't blame him doing everything in her power to protect herself.

She's just asking to get murdered at some point in her life, and I won't feel the least bit sympathetic if she does. :o

Bollox. This **** of a woman was over the speed limit anyway. She killed a young boy and hospitalised another... and she's suing them because of "trauma"?!?
 
90 in an 80 zone. Her husband is a cop who was following behind her in another car and when other cops showed up they didn't do any type of drug or alcohol testing.

She is counter suing them because they wanted to make it a legal case in the first place.

Not much granted but its still speeding. I think that needs to be considered in this. She was going faster than she should have, she hit and killed a kid and is now suing for the trauma she suffered?

Sorry counter-suing. Which to my mind is not much better.

I am guessing either her lawyer or insurance company are the ones telling her to counter sue(more so the insurance company since they will have to foot the bill if she loses the original lawsuit brought forward by the kids parents)

Possibly. I woudn't like to speculate without all the available facts. But surely they must have realised how this would have looked. Fight the suit by all means, but counter-suing over your emotional distress, that just looks and seems lowlife.
 
It's likely just a front so the families will drop it and settle without court.

As I said I don't think the goal is to win the lawsuit against the kid, it's basically to make the original lawsuit fail(or as Kevin pointed out settle out of court). it might seem like an ******* thing to do, but she is being sued herself for like 900k(which seems a bit high given Canada has socialized health care so you don't have medical fees)
 
I don't understand... if she was going over the speed limit, why has she not been charged?
