A JUDGE who once caused controversy for describing a burglar as courageous, has refused to jail a paedophile for fear he will "have a hard time in prison."

Judge Peter Bowers has caused further outrage after letting Mark Martin walk free, despite already being on a suspended jail sentence.

Martin was found with indecent images on his mobile phone, and had been using his brother's computer to download other images of young boys and girls.

But although the 24-year-old broke the terms of his suspended sentence, Judge Bowers had his concerns about locking him up.

“This really is your last chance,” he told him at Teesside Crown Court on Friday as he passed yet another suspended sentence.

“You present quite a problem for me because, in theory, you had breached the suspended sentence,” he continued.

“As most people will know, if people do breach a suspended sentence, then it is almost inevitable they go straight away to prison. But I have read with some concern about you, and this addiction you have had of looking at pornography of little children.

I think you would suffer very badly in prison and I don't think, at the moment, it is necessary to send you there today.

“I am going to give you another suspended sentence, but you have got to understand it is the very last chance you are ever going to get.

“You are probably doing the right thing not to have any internet access... it is a temptation you will find very hard to resist.”

His decision will cause another public outrage, especially as prosecutor Sue Jacobs told the court that a total of 48 still and moving images of child abuse, some in the worst category, were found on his devices.

Martin, was given a 12-month jail sentence, suspended for two years, with probation service supervision.

This is not the first time Judge Bowers has come under fire for his decision-making.

In September last year, he described serial burglar Richard Rochford as 'courageous' but his words were taken as a 'serious error of judgement', especially when he opted not to send Rochford to jail.

He was instead given a one-year prison sentence, suspended for 18 months.

sadly no. this judge has been in the papers in the past for saying it was courageous for a guy to break into peoples houses

and its been reported on few sites and papers
 
I imagine the judge's comments while inspire a certain brand of courage in other individuals. He better not give them lip when their courage inspires them to action, either.
 
This idiot should not be allowed to be a judge. Paedophiles deserve to suffer badly in prison.

Well that too. Probably best a child isn't subjected to his logic.

At the very least, the guy needs to at least be put under psychiatric observation and therapy to help curb his problems. Probation most likely isn't going to stop this guys habit.
 
Psychiatric help isn't going to do anything. Paedophiles are like serial killers and rapists. They never stop. How many children have to be abused before the bleeding hearts of the world get that?

The only therapy should be for the victims. They deserve the help.

I'm not a bleeding heart. I just fully recognize the fact that thinking that people are beyond some form of help is not in any way helpful, and a large problem with the US penal system. Most violent and/or sexual crimes can be linked to some underpinning psychiatric problem. Ignoring that fact is the reason why these sick people slip through the cracks and have opportunities to engage in these activities in the first place. The guy is sick in the head, and therapy could help in some capacity. Its better than just cutting him loose like this judge did.

Men raping each other, while admittedly a certain form of justice, solves absolutely nothing. It doesn't in anyway get at the core problem in a broken person. Locking people up and simply forgetting about them isn't working. This is proven by America's ridiculously high prison population and its ridiculously low effectiveness.

The children who are victims of this should definitely get therapy to help them and to make sure they don't become abusers themselves since that can happen.

As for the ones who are already adults, unfortunately, it's probably too late for them.

Yeah, the pedo. I think. Hard to say, really. She doesn't like judges that much.

If the guy in question has actually abused children himself, then I'd be more inclined to agree. However, in this case I think a distinction between simply downloading images and creating them isn't unreasonable.

The former is obviously reprehensible, but I don't think it should be placed in the same category as the latter (in terms of severity). Granted, what the guy did is quite obviously illegal, and I'm not sure I agree with the judge's reasoning, but people are responding as though this guy has actually gone out and diddled little children, and that doesn't appear to be the case (that we know of).

Is this behavior a cause for concern with regard for the potential of abuse in the future? Absolutely. That's why I'm a bit conflicted about this whole thing.
