Prosecutors often don't bring mistrials back to trial, if it is the result of a simple hung jury. They *can*, yes, but it is normally a long, expensive process, with all the witnesses separated that much more from the crime. If they don't expect any different a result, they typically won't bother. This could easily apply whether the prosecution here suspects malfeasance or not.
