One's I've done:

Illegal drug use: underage drinking, not a huge deal.

/batteryassault/disorderly conduct: fighting.

Wrong. Technically speaking, assault is any illegal contact with another person, meaning any unwelcome contact. Battery is the same thing but with the intent to inflict harm on the other person.

In my previous post, I meant to say battery is threatening or intending harm and assault is just harming another person.

To be more clear, if you get in a fight with someone and just try to defend yourself, that's assault. But if you get in a fight and try to break the other person's nose just to cause them pain, that's battery.

Battery is the more serious offense, unless the charge is aggravated assault.

I'm glad you know how to copy and paste from some web dictionary and yeah, that's might be the legal definition in the books, but its not the law in action and for the most part, statues don't define "assault" as a threat. For example, if I say "I'm going to hit you with this hammer," that's not assault. However, if I swing the hammer at you, it is. And hey look, I can copy and paste too.

"A threat is distinguishable from an assault, for an assault requires some physical act that appears likely to eventuate in violence, whereas a threat may consist of words only or an act that is not violent, e.g., unlawful prosecution. Threats made to obtain money or property wrongfully are crimes (see blackmail and extortion), and under some statutes, the mere sending of nonextortionate letters that announce an intent to injure the person or property of another is criminal. Any contract concluded while one party is deprived of his freedom of will by a threat (see duress) is invalid and may be set aside."

Yeah, its not like a normal thing. First time and only because we had a few drinks with some friends at dinner and I had to work early so took two Tylenol PMs to get some sleep. :o

I've murdered someone in my sleep. Strangled with my bare hands...I'm PRETTY sure I stuck my thumbs through his neck (like pierced the skin into his throat kinda thing). It was the worst feeling I've ever felt.
