Methodical planning doesnt really rule insanity but it most definitely will rule out his lawyer trying to claim he isnt competent to stand trial. They love trying that but in this case anyone who can plan something like this can stand before judge and jury.

The psychiatric evaluator will come to that conclusion wether he is aware of what he was doing. At this point thats Holmes only possible defense and he is clearly trying to act the part. However, the fact he planned to get away does not bode well for that theory and the police and FBI are making sure the public is aware of the meticulous planning because it will be a key issue to prove this was a premeditated homicide and not a sudden atack where the person wasnt aware of what he was doing.
 
It will be hard, what I saw today certainly didn't help that case any.....

#1. I would not have allowed the camera to be where my client was almost seen straight on. Most of the time those cameras (cellphones) are over the shoulder of the defendant.
#2. If he was on medication, I would have asked that the medication be lessened before going to court.
#3. He has to be shown that he is competent for trial, and even though he didn't talk....many described him as being sad, and that goes toward him knowing that what he did was wrong...

None of what I saw today helps in the competency or insanity. These are both subject to different times, Competency is at the time of the trial, and insanity, at the time he committed the crime. What I saw today, screws both of those things.....but that is all they have, so they have to go for insanity.

I only saw a 1:25 video of Holmes in court today. In what I saw, he didnt seem to be out of it, on medication or playing the part of an insane person.
Did I watch the edited version?

In the course of my career I have easily seen over 1,000 defendants in court for change of pleas, initial appearances, sentencings, trials, etc....I didnt see anything out of the ordinary. Is there a video link that one of you could provide?

Doesn't matter if it was planned or not, that doesn't mean he isn't insane. If he had a dream and hears voices that had him planning this out for a while, then that would be considered insanity.


That's not what that defense is dependent on however.
 
One way or another, the man is obviously some kind of sociopath or psychopath. I mean, he shot at random at dozens of people, including children.

Even so, the insanity defense actually rarely flies in court, in spite of what movies say, ironically. The main thing is, it´s really to convince a jury the killer was somehow unaware of what he was doing, or that it´s morally wrong, particularly in such horrendous circumstances.

I think he should be classified and dealt with like a rabid dog and be put down. There's no doubt he committed these premeditated crimes. There are some people who just shouldn't be part of this world....he's one of them.
 
Not really. I think that just muddies the waters. If we do that, we have to start making fine toothed definitions about murder when we already have degrees of murder. It just complicates things. Just treat this incident as a crime, not as a case of terrorism.

The problem is, in a weird way, this kind of glorifies him, cuz as horrifying as terrorists are, they always claim to be defending a noble political cause. This guy has no cause other than whatever delusions inhabit his mind.
 
Most people that do this want us to view them this way, because in some small way it gives them what they want. "I was able to evoke this kind of response from the masses, I have succeeded." A lot of them don't care if they get killed or not.
 
That's why I only watch Brian Williams on NBC, dude keeps it real and doesn't over-dramatize everything.

I though the guy looked more exhausted than anything and like he was going to cry at some points. Maybe reality is kicking in and he's coming out of whatever delusion he was in leading up to this massacre.

He looked very medicated to me...

Hey, if the AR 15 can be made to only shoot 6 rounds at a time.....more power to it....I don't really care what the gun is called, the caliber used, whatever.....but the amount of ammunition that some of these weapons can put out in a few seconds is not good, and that needs to change. The fact that this guy was able to buy armor piercing bullets is ridiculously stupid.....it is moronic that we have that available to the public....totally moronic.

They might care if we make their death slow and agonizing. Really put the fear in them and keep inching death towards them and pulling back at the last second until they beg for it then make them take their own life. Too cruel?
 
If somebody is buying military grade weaponry and you don't ask for some type of clearance or something, is that not a red flag? Or is money your only concern as a dealer of this stuff?

I think there are many areas that we could strengthen....and that is one of them, I also think our mental health system needs some major work as well.

So, IMO, its not JUST gun control....there are other areas that need to be looked at right along with these multi-firing weapons, since some don't like them being called assault weapons...lol

I have a better idea. We should have something like The Running Man. Except instead of having a wide open urban area for them to run through it's more like the size of a mobile home. And instead of the flashy gladiators they should just use hungry tigers. Third, instead of the fancy spandex outfits they should get a large steak to hang around their neck. And finally, instead of winning freedom if they reach the end (of the mobile home), they'll just get another tiger.

The world should start referring to him as The Riddler instead of the Joker. That'd really piss him off.

If somebody is buying military grade weaponry and you don't ask for some type of clearance or something, is that not a red flag? Or is money your only concern as a dealer of this stuff?

All his weapons were civillian grade. The AR-15 is the civillian model. It is semi automatic only with no selective fire. The military grade is the M4 & M16 both of which have selctive semi and automatic fire. You can not buy the M4 & M16 on the civillian market as they are clasified as assault rifles because they have selective fire.

It had nothing to do with the movie, whether he tried to blame it on the film or not, his red hair betrays his ignorance and absolves these films.

The only problem is, most of the psychos kill themselves so they can't be arrested. I think that's the one of the most amazing parts of the incident, is the psycho is still alive. He obviously wants to see and "admire" his work.

He wants to admire some wondeful work then he can admire the wprk of his torturer.
