Depends on the state. Where I live there are no penalties for shooting and killing an intruder.

I've heard of quite a few cases where people have gotten in legal trouble for shooting and killing an unarmed intruder, or one who only had a knife, or for stabbing an unarmed intruder, etc.

I believe the law in Texas also applies to your person, and your property. Catch someone breaking into your car, you can shoot them. The thing is you have to catch them, you can't hide out and wait.

The original Texas Chainsaw massacre was meant to highlight the flawed nature of that law...The message didn't really get picked up over there did it?

In Australia you'd get Fu](ed on. First what were you doing with a loaded gun in the first place etc. And secondly, just cause someone is in your house doesn't mean they're trying to kill you (therefore self defence is gonna be hard to establish). Remember you're taking a life of a human being with friends and family that care deeply about them.

In this case though, where the lady showed restraint and didn't pull the trigger, and caught herself a thieft (albeit a kid) it's hard to think of this old lady as anything but an awesome granny. But assume for a moment there were more fact to this case, perhaps he had merely been dared by some friend to enter the house as some stupid kid prank, and the gun had been fired....
