According to the Hollywood Reporter, the actors would have only had pay or play deals, if the studio didn't pull the plug on the project by the Jan. 15 deadline. That's why it was so urgent for the studio to make it's decision regarding this movie last January.

I think its pretty stupid that WB paid all this money for pre-production work for a movie they weren't sure about.

Of course, but they paid at least $120m for Speed Racer, so there isn't anything new.
