SAN BERNARDINO, June 29, 2007 - Outrage at justice not served, and gratitude expressed to the jury for a "not guilty" verdict -- those are the two opposite reactions to the acquittal of former San Bernardino Sheriff's Deputy Ivory Webb in the shooting of an Iraq war veteran that was caught on tape.
That videotape appeared to be so damaging to Deputy Ivory Webb; it showed him shooting Air Force Senior Airman Elio Carrion several times as Carrion was laying on the floor.
But there was other evidence in the case. Jurors say that the other evidence helped to convince them that Webb was not guilty.
Webb was facing up to 18-years in prison if found guilty on the manslaughter and assault charges. He shot Carrion in the chest, the shoulder, and the leg after Carrion and another man led the deputy on a high-speed chase back in January of 2006.
A resident captured some of what happened on videotape. On the grainy, 40-second video clip shot in darkness by an area resident, Carrion can be heard swearing at Webb before the deputy tells him, "Get up! Get up!" Webb, who is shouting expletives himself, then shoots Carrion in the chest, left leg and left shoulder as the victim appears to be obeying the order.
But jurors say the video does not tell the whole story.
"I want to thank the jurors, who came to an honest conclusion considering all the facts and came to a justified conclusion," said Ivory Webb.
"A military hero serving the United States of America gets shot down three times like a dog, and the criminal goes free," said Carrion's lawyer, Luis Carrillo, outside the courthouse. "The world is upside down."
Carrion was on leave from the Air Force when the shooting happened. He has recovered from his injuries and is currently serving on a base in Louisiana. His attorney is considering federal civil rights charges against Webb.
Webb is no longer in the San Bernardino County Sheriff's Department.
