AUSTIN – Gov. Rick Perry today joined state Rep. Brandon Creighton and sponsors of House Concurrent Resolution (HCR) 50 in support of states’ rights under the 10th Amendment to the U.S. Constitution.

“I believe that our federal government has become oppressive in its size, its intrusion into the lives of our citizens, and its interference with the affairs of our state,” Gov. Perry said. “That is why I am here today to express my unwavering support for efforts all across our country to reaffirm the states’ rights affirmed by the Tenth Amendment to the U.S. Constitution. I believe that returning to the letter and spirit of the U.S. Constitution and its essential 10th Amendment will free our state from undue regulations, and ultimately strengthen our Union.”

A number of recent federal proposals are not within the scope of the federal government’s constitutionally designated powers and impede the states’ right to govern themselves. HCR 50 affirms that Texas claims sovereignty under the 10th Amendment over all powers not otherwise granted to the federal government.

It also designates that all compulsory federal legislation that requires states to comply under threat of civil or criminal penalties, or that requires states to pass legislation or lose federal funding, be prohibited or repealed.

HCR 50 is authored by Representatives Brandon Creighton, Leo Berman, Bryan Hughes, Dan Gattis and Ryan Guillen.

I agree. Anything to diminish Federal Power is good.
 
Here's the issue though:

In order for the states to pull this off theres going to be a lot that has to happen. Including the reduction of Federal Taxes in favor of possible higher state taxes, since the states will now have to decide about which social programs they wish to focus on.

I agree with the 10th amendment and reduction in federal government size to focus on only those issues which cannot be controlled on a state level, but I dont see them backing down from the $$ to pull this off.
 
It would be great for Conservative governors across the nation to make a joint declaration of this type.

So, is he talking about becoming a soverign state, or just...eh, sorry...I'll just read the whole thing and than comment.

No. Texas telling the Government to read the Constitution isn't an act of war, its an act of common sense.

The US would never let Texas leave the union...
regardless what is in our constitution

Even though secession is illegal from the status quo set by the Civil War and the federal government is above the state governments, the states do have certain degrees of sovereignty that the federal government needs to respect.

It's nice to see that we have two Presidents in a row who completely disregard and throw away parts of the Constitution they don't like.

Bush started it...and now Obama is adding more to it.

By Lincoln's logic, we should still be a colony as it was anarchy when we decided to secede from the British Empire.

At any rate, Perry is not trying to get Texas to leave the Union. He simply trying to force the government to acknowledge the laws laid forth by our Constitution in regards to respecting the soveirgnty of a state.

Does the Constitution have legal weight? Specifically the tenth amendment to it? The federal government was created to be an agent of the state which oversaw national defense, printing of currency, and trade laws. Now its completely flipped around to the point where states are subservient to our federal government.
