A great day for Superman fans. This means that DC and WB were right all along.

Now we can get more Superman movies and a long overdue new animated series as well as a live-action TV series. I wonder if DC will revert Superman back to his classic suit with red underwear.

And seemingly, at least to me, it took DC rebooting its whole universe into the New 52 to camouflage it.

I still don't like what they've done with the Kents, making Clark completely orphan. I even think Lois's role in the New 52 also took a hit because of this lawsuit.

Ma and Pa Kent weren't in Action Comics #1, so whether they are alive or dead has nothing to do with anything. Plus, all the reboot did was restore an aspect of pre-crisis continuity. I mean, ever since it was established that Clark even had human parents, they were said to have died by the time he reached adulthood and became Superman. Well, until John Byrne said otherwise. Also, Action Comics referenced the protoypical Superman who had limited powers and could only jump and not fly, and used rowdier tactics and dealt with social injustice. I mean, isn't that the exact opposite of distancing Superman from the version that the Siegel estate was to regain?

Asides from the Kryptonian armor, Morrison made Superman more like the Superman that Siegel and Shuster designed though. The Kryptonian armor is more along the lines of Jim Lee liking to add a bunch of unnecessary creases to his designs and DC's mentality that trunks are now goofy.

His deal with the Siegels and Shusters was that if they lose, he gets nothing, but if they win he gets 49.7% of the Superman copyright along with the film rights and other stuff. However, now that WB will inevitably sue him for what he's done, his greed is essentially going to cost him lots of money.

Done in what way? They'll call up every writer who was on a book before the reboot and pick up exactly where they left off before Flashpoint? There's no going back, the only thing they can do besides keep going is reboot again, and that ain't gonna happen in this decade.

Although I'm not American, as someone who is about to write his Bar Exams in a couple of months, I'm not quite sure what Warner Bros would be able to sue him for. In Canada, the UK, and other Commonwealth systems, losers of civil suits are normally liable for the costs of the winning party. So if you win, the other side has to reimburse you for your legal fees basically. In practice, it's more complex in regards to how much the winning party is reimbursed, but that's the basic idea. It is one of our safeguards against ambulance chasers and frivolous lawsuits. The U.S. is unique in that it does not have such a costs system. Each party bears their own costs regardless of winning or losing. Many legal academics point to this as being one of the main reasons why Americans are so lawsuit happy.

True, Warner Bros. might be able to pursue a claim for the tort of malicious prosecution against the heirs, but proving malicious prosecution is rather difficult. If I recall correctly, the lawsuit needs to be frivolous such that it is an abuse of process. Given that a trial judge decided in favor of the heirs and the decision was only overturned upon appeal, it is hard to argue that the suit was without merit.

Had Siegel & Shuster won, Toberoff would have got hold of 49.7 % of Superman property and Toberoff had his own production company called Pacific pictures which would have struck a deal with some big named Studio to make a Superman movie.

Interestingly , Marc Toberoff is also representing Jack Kirby Estate against Marvel in a similar case over rights issue, which is still ongoing.

I thought we should be thankful for the lawsuit? If not, WB wouldn’t push hard to make another superman film by 2013.
Superman would have suffered the faith as Wonderwoman and Flash. Headless and directionless years after years trying to make into the silver screen. They were more popular than Ironman and Thor years ago. WB/DC is so gutless and never have faith on their own characters unlike Marvel.
And MOS is a complete solo and never intends to go the trilogy style because they thought they may lost the right after 2013.

A great way to celebrate the milestone 75th Anniversary of Superman with the upcoming Man of Steel movie and WB/ DC winning the copyright case. Now it's time for a plethora of Superman films and animated series.
