Texting teen falls into open manhole

Well one of them should've watched the hole while the others got the cones or had the cones ready to go when they opened it, so they do have a viable case against the city...

That is a perfectly logical argument but what are the odds of someone falling into a manhole right after you've lifted up from the ground to gain access? I mean how dumb would you have to be. This stuff only happens in cartoons. If that were me I would not only not have told anyone; further confirming how dumb this person is, because now with the parents suing this will bring even further attention to her stupidity.
 
Different situation... and in truth, they probably would be able to sue the driver in your scenario as pedestrians almost always have the right of way in any situation.

Those workers created an unsafe situation, a child could have fallen in there as easily as a stupid teenager.

And they should be punished for breaking the rules, but she shouldn't be awarded any money.
 
I would say that any medical care needed should be paid for by the city, but more than that......no.
 
It's idiotic to walk into a manhole, regardless. She should have been paying attention to where she was walking, period, especially if she's out in the street. That's incredibly dangerous. That said, if there's a random open manhole with no signage, etc, she deserves her medical bills and a token amount of pain and suffering ($500 bucks or so), and that's what she'll get.
 
Manhole is such a sexist term. I vote we change it to Womanhole.

If I was one of the parents, I'd be chastising my own daughter instead. She should've been watching where she was walking. Or I'd have told her to stand by somewhere to complete her text before continuing to walk.

Is this such a hard concept to grasp? They aren't suing because of their daughter's stupidity, they are suing for the danger the open manhole (get your minds' out of the manhole) presented. Their daughter, or any pedestrian, could have been severly injured/killed due to the worker's not creating a safe work environment for themselves and others in the area. Or at least that's what they'd present in court if they were smart, or have a decent enough lawyer. I don't agree with it being a completely fair system, but I understand the train of thought of being angry that their child could have been been seriously hurt from something like that.

I also don't believe that the workers were just about to put cones up. I would bet that they just didn't put them up at all. Anybody who has any sense of personal responsibility will of course say, "Oh, I was JUST getting ready to make sure nobody would fall down into our open safety hazard by putting the required cones around it... you should have walked here 1 minute later".
