I don't really consider Magneto to be a villain either (more of a morally ambiguous anti-hero or misguided revolutionary). Erik has been a member of the x-men several times (including right now). He and Mystique fall into a similar category in that regard.
If we exclude those two, my top villains are.
1. Apocalypse
2. Mr. Sinister
3. Bolivar Trask and the Sentinels
4. William Stryker
5. Bastion

True, we've got Dexter, The Punisher, Sons of Anarchy, etc. Magneto's never really been an out and out villain to me. Dangerous yes, but not evil (Stan Lee said that about Magneto).

I think they WERE X-Men just weren't called that until the end with Moira. Like, the first guy to invent a pizza didnt know what to call it yet but what he made was still a pizza. Then his gf came over and said mama mia a pizza and there you go ... Same thing here!
