I mean in 3 pages they did it when Kelly was on Superman this is your life and they went before congress because they felt like the heroes can't be trusted.

Yeah, the Golden Age heroes were forced to come before the House Un-American Activities Committee ("HUAC" for short) after WWII, when Cold War paranoia was setting in all across the world. Everything's been used somewhere else before. That doesn't mean that Millar couldn't have gotten the idea from Marvel.
