I was talking with a buddy of mine and the issues of rights came up. He asked could Quicksilver and Scarlett Witch be part of The Marvel Cinematic Universe. I said I don't think so and we began looking at what characters FOX had and didn't have and thought about how could Disney make a mutant movie without FOX.

Alpha Flight- Could Marvel Studios get away with not really making a movie about Alpha Flight, but say reference them as part of the MCU.
Reason I ask because Alpha Flight isn't really the X-Men.

Has any of the following Alpha Flight Characters been in or mentioned an X-Men film?

Vindicator
Puck
Snowbird
Shaman
Sasquatch
Northstar
Aurora

I know FOX isn't going to give up the X-Men franchise up any time soon, but isn't there over 2,000 mutants does FOX have the rights to all of them?

Marvel owns the rights to the x-men universe which includes its wide span of stories and characters, further more, they cermented that right when they made wolverine a icon figure from the movie franchise closely linking stories featuring wolverine, that hadnt been taken by other studios...

so for example where Alpha Flight, Silver Samuri... X23 - any story featuring them which previously hadnt been taken by any other studio

Where as any story featuring Hulk, Ironman blah blah blah...

So essentially the answer to you question is Fox owns Alpha Flight...

However there is an exception to the rule...

Although Fox has the monopoly over the characters, they can still return the rights to Alpha Flight if say they wernt going to persue its creation.

But that would be something along the lines of

Studio 1 (Marvel Studios or Sony or Universal) Studio 2 (Fox)

Studio 1 "Can we have the rights to Alpha Flight to make it into the movie?"
Studio 2 "Well, we love Hugh Jackman"
Studio 1 "(Arkward Silence)...OK, but basically we have this idea to mave a canadian superhero team, which could potentially be something new... There canadian"
Studio 2 "So is Wolverine, doesnt he have beautifle eyes..."
Studio 1 "Look we know that Alpha Flight has had some involvement with Wolverine..."
Studio 2 "OoOo you said Wolverine"
Studio 1 "We're willing to give you say this brief case full of money, for the rights to use this franchise"

And this is the point where you have too scenarios...

Scenario 1

A few Fox members gather in a huddle acting way to sinister
Studio 2 (Larry) "Well, Wolverine is erh, erh, erh is going on vacation"
Studio 2 (Dave) "After Japan of course"
Studio 2 (Larry) "Yes, in Wolverine 3 wolverine is going to have a vacantion"
Studio 2 (Dave) "In Canada"
Studio 2 (Larry) "Yes in canada, and well we need him fighting in a bar at the end of it so Of Course wolverine is going to run into Alpha Flight"
Studio 2 (Dave) "Naturally"
Studio 2 (Larry) "So no, you cant have the rights because basically we could make lots more money making alpha flight so i can spend that money with spa breaks with Hugh Jacman, so we may want to make a wolverine movie in the future"
Studio 2 (Dave) "Alpha Flight Movie"
Studio 2 (Larry) "Sorry yes i mean Alpha Flight Movie"
Studio 2 (Dave) "Oooo staring Wolverine!"
Studio 2 (Larry) "Yes, we will call it, Wolverine and The Alpha Flight"
Studio 2 (Dave) "Thats quiet a long title"
Studio 2 (Larry) "What do you suggest?"
Studio 2 (Dave) "I dunno, Wolverine...and...erh The Other guys?"
Studio 2 (Larry) "Perfect, so Studio 1, unfortuatlly"
Studio 2 (Dave) "They left five minutes ago..."

Scenario 2 could be this...

Studio 2 "Is that a Million?"
Studio 1 "You want 2?"
Studio 2 "Lets round it up to ten and we have a deal"
Producer for Studio 1 "Isnt that the entire budget for alpha flight"
Studio 1 "Shhhhh, we will film it on a sony handycam and say its a revoltuionary new filming techique like Cloverfield..."

Good lord. The amount of typos in this post is astounding.

You're pretty accurate though. Alpha flight was introduced simply as a part of Wolverine's back story. Unfortunately though they've had several series' of their own, I don't think this was enough to make them their own property outside of the x-men. Especially one that I'm sure no studio would ever think would be profitable WITHOUT wolverine.

So yes, Fox has the rights. I don't think you can count on a movie being made unless Marvel/Disney can wrestle the x-men rights away from Fox.

I hope to god this is misunderstanding but I can only dream. Sadly I heard this foolishness that Marvel did with the x universe before. It looks to be true that FOX has the rites to nearly all the mutants in the Marvel universe. I believe the few mutants that FOX can't hold are Namor, Firestar Whirlwind and Marvel Boy/Justice. I can't think of any other well known mutants off the top of my head that didn't come out of the Xmen universe.

I'm not 100% sure if they own the rights to ALPHA FLIGHT as a team, but I do know they own the rights to some of the mutant team members, like Northstar, etc.

I think they may have the rites to Alpha Flight as ateam. It's it Wolverine and the Xmen releated? I'm not sure but all the cool mutants Fox owns.

i also wondered about what characters fox owns. also they own the silver surfer rights so that also might mean alot of cosmic characters are off limits too. i hope not since there are tons of stuff i would like to see. fox has the ff rights so marvel really has lost alot of characters in just those franchises. i really hope they get them back soon.

Whaaaat say Whaaat!!! Jeez I forgot the F4 and SS. If this is the case with those two properties as well then FOX got characters that they will always hold on to even though they will never make a movie. The Inhumans would be an interesting flick, but don't tell me FOX has them. I'm not sure I think it may be a lil different. The Xmen is a large universe and ton of mutants have been in the xmen. It's kinda different with the F4, although I know a Black Panther flick of good quality will never be made I still hope for a dream BP movie done right. It would pain me if FOX owns the rites to BP.

Actually Silver Surfer is a special case... other studios can produce space related marvel properties...

Yeah Fox has fantastic four, Silver Surfer and Galactus. But Spiderman has venom which is techically an alien which spiderman is still with Sony
Then you have Paramount pictures who is making Avengers who arnt they dealing with Skrulls.

So space in the movies has to be seperated. For example

Anything - Shi'ar or Brood related would be in an x-men franchise although probably never would happen
Anything - Venom, Beyonder, The Man Wolf story would be Spiderman franchise
Anything - Skrulls, Kree, Captain Marvel, Fin Fang Foom - avengers franchise
Anything - Galactus, Silver Surfer, Anhilanus, Possibly the Inhumans too but there origins would be left out of the movies.

I guess these perticular characters would fall under the specialisities of the contracts they would of signed. Because characters appear in different franchises from time to time. But they will look at were these characters CORE of stories came from... so like i said above.

Are you sure the Skrulls aren't FF territory? I ask only because I'm pretty sure they originated in the FF and eventually moved onto other franchises. Like how Sabretooth and Mystique were Iron Fist/Ms.Marvel villains before becoming associated with the X-Men, so I don't know if Fox fought for the rights for the Skrulls or not, just based on the character histories.

Skrulls have appeared about half and half between avengers and fantastic four over the years. People probably associate it more with Fantastic Four but im sure Avengers are using them in there story. Alot of legal work is probably involved over this.

silver surfer was left out of planet hulk due to litigation. so i was thinking they would have to do the same for other characters in their movies or animated movies. i just wanted to see galactus vs the avengers and the ff. that would have been a good avengers movie.

The Ultimates made their own version of the Skrulls (I can't think of the name right now), so the Avengers and FF could very well use the Skrulls in one form or another

Fox owns the Super-Skrull, but Marvel retains rights to the Skrulls.

Interestingly, Scarlett Johansson mentioned Marvel had been interested in her for several characters including Scarlet Witch before she ended up as Black Widow. That would indicate Scarlet Witch remains a Marvel property and won't be cropping up in an X-Men flick.

Such a shame these rights are so rigidly and fiercely held.

How come Wanda is owned by Marvel, yet Pietro seems to have been in Wolverine as one of Styker's captives?

really? Where?

In one of the cells. Restrained by straps and trying to escape them at superspeed. Could've been Northstar i guess, but the obvious assumption is Quicksilver.

Well, they never called him Pietro. I wonder if they barely got away with his likeness without actually using him...

I guess the superspeed and the white hair could also be applied to Northstar - it'd be clever of Fox, just in case they don't own the rights to Pietro.

How come Wanda is owned by Marvel, yet Pietro seems to have been in Wolverine as one of Styker's captives?

Wanda has had such a long association with The Avengers, so they may have wanted to retain rights. Not that i can easily see mutants being introduced in Marvel's current wave of films. More than likely she'd be linked to Doctor Strange as a pupil/apprentice and they'd play up the magic angle more than the mutant angle.

Well Scarlet Witch was an unnamed cameo in X-Men Origins Wolverine and in X-Men 2 her name was under Maximoff 2 on strykers computer. Fox owns the rights to the character.

If Marvel was interested in her being Scarlet Witch it would most likely of been for X-Men First Class. Than Avengers.

Shouldn't we have seen alpha flight in the first wolverine movie. Unless they show up in part 2 as a recovered memory. I just want to see big ass Sasquatch, even if it's in a crappy movie. Also guardians suit is very cool.

I think it depends on where they decide to do Wolverine 3 or not . I'd rather see them in their own film. Until then at least there's the cartoon
