Remember when cellphones with cameras first came out and perverted people (like AndThePickles) would take pictures of random hotties in the streets or at school or whatever? Now we have the iPhone and all these sophisticated new cellphones. Do you think that as a result things have gotten a bit more extreme.

Like, for example, I was at YouTube the other day (what else is new) and saw a video some guy had taken of a girls ass at some store. I mean...a few years back you would have never seen this. No one would go through all this trouble. I mean, yea, you may have taken a photo or video and showed it to your friends but putting it online seems like too much effort. But, now everything is just a few clicks away.

I think this is a dangerous thing because now more than ever people will be having their privacy invaded.

I don't know if taking a picture/video of a girl's ass is invation of privacy, but I guess there's a domino effect. :huh:
 
The only things that are considered private in a store are the restrooms and the changing rooms. There is no expectation of privacy when you're browsing the video game section or getting some beer or trying on some shoes

I remember back in the day reading articles of people taking pictures in those places. I recall one had a photo of someone taking a dump in a public bathroom. It made me laugh. :o

I would say that is an invasion of privacy, especially if it's been posted on the internet. You can get in a lot of trouble using someone's image without their consent. When you're filming there is a lot of paperwork to make sure everyone appearing on screen has consented for their image to be shown, and if they don't consent you have to blur out their face or exclude the footage.
 
If you're walking around Wal-Mart and someone has a camera up your ass that's invasion of privacy IMO.
 
I don't know if anyone is familiar with the site HCWDB.com....google it if you don't know...but they get at least 2 or 3 requests a week to remove pictures from their site....you can't use someones image (and yes that includes body parts) on the internet without their consent
 
Technically you can take pictures of anyone (including minors) as long as you are on public property (sometimes private, depending on what sort of establishment it is). Also technically this is not an illegal activity, however people could press charges if the court deems the photography lewd, offensive, or invasive.

Also, I've heard of cases recently where employees of companies that see senstive information (CC numbers, SSN) are using cellphones to take pictures of this information for later use.

I doubt you can take pics of minors, seen in newspapers people being busted for taking pics of kids and actually being prostitute, hell a dude in California or maybe it was Texas was busted for taking cheerleaders pics
 
So...this begs the question...is it any more wrong to keep an image of what you saw than to keep a mental image of what you saw?

Is taking pictures of people you'd like to look at again later actually iilegal?

Yes there's a difference; one is a deliberate act while the other occurs sub-consciously.
 
Im not a lawyer, but I used to run a talent agency, and working with bands and festival events have put me around lots of photographers and all of that...so heres my opinion.

First of all, hot chicks are everywhere...seeing one that you feel the need to save in your cellphone, and even post on the internet is a little creepy. Its not mardi gras or spring break girls gone wild...its some chick standing in line at a store. If it is mardi gras and you get some boob shots, the girl is an idiot and shouldnt be mad at anyone but herself.

BUT...

Whether indoors or outside (except for bathrooms and changing rooms) a person does not have any legal right to not be photographed. Therefore, unless you're doing something that a court would consider an invasion of their privacy, you're fine. In fact, if a security guard tells you to stop taking pictures, you dont have to stop, but they CAN tell you to leave...snapping pictures all the way out the door. Cops are different, they can tell you to stop.

You cannot sell their photos, or use their their photo to sell something without signing a model release...otherwise they can sue. Also, if they sign a model release and you use it in a way that the person considers harmful to their reputation (for instance, taking a picture of a girl sitting on a bed and then using it as a porno cover), then they can sue.

As far as voyeurism goes...like trying to take pictures up girls skirts...that part I know nothing about. Im under the impression that its a hazy law...its illegal in some states, but others not. I wouldnt risk it, pervs.

You seem to know a lot about the subject, have you had to defend your photographic exploits before?

Once some guy took a picture of me and my friend eating at a restaurant at school and put it on his photography site (not for sale or anything). It was weird to see!
 
I'm an artist, and I'm constantly bringing my sketchbook places and discreetly sketching people. Sometimes when I'm at the student lounge or in the park, I'll see a cute girl sitting in a way that I think looks interesting, or I'll see an elderly person who's face has lots of character, and so I draw them. I don't know if I'd necessarily say taking someone's picture with a cellphone is the same thing, but it does kind of fall under the same legal territory. If someone says it's illegal to take someone's photograph without there permission, they could in theory tell people like me that it's illegal to draw people without there permission, because they are both means of visually recording a person's image.

It's a gray area, but it would be really annoying if people like me constantly had to worry about getting sued. It was hard enough to learn how not to get the attention of someone who I'm trying to sketch, but if there's a legal precedent against it, then some slip-and-fall types might start eying me with more suspicion whenever they see me take out my sketchbook and pencil.

I hear that sketching a girl is a good pick up line type thing...

But for practical, work related purposes, youre right. Teenage girls especially have...unique...ways of standing. Im not exactly sure how its comfortable to be standing there with their legs in pretzel like contortions, but they do...so I assume it could be used for reference, kind of like the way writers will listen to converstions to pick up slang terms and phrases that people use who arent in that writers "type" of friends.

To a degree isn't this invasion of privacy and all that good crap? I mean technically it's a bit creepy and you could probably be arrested for recording someone's bodacious ass and rocking buns. :(
