Joe Rogan vs. Carlos Mencia

If he hadn't apologized and agreed not to use the bit again I definitely would've brought his ass to court. And while I'm not a big fan of Rogan's comedy, I actually like the amount of a vendetta he's taking against Mencia, and the fact that it's getting this much attention (it's also on CollegeHumor, and now more and more of my classmates are seeing the truth), because it is sickening just how much money he's made off of other people's ****.

Rogan should be putting Mencia through the legal meatgrinder with a class-action lawsuit if he's really guilty of all that (and I'm not saying he is or isn't). Now THAT would be commendable and set some legal precedent for future artists who might consider swiping other artists' material or product.

Maybe Rogan is jealous, but he has been accusing Mencia for years. Even when Rogan was the guy from Newsradio and Mencia was a nobody.

Maybe we're both right. Maybe Rogan is both jealous and angry. I don't know.
 
Mencia makes himself look like a fool so it isn't much of an accomplishment. Comedy is about more than creating jokes. It is about timing and delivery. For his intended audience (Which admittedly is rather juvenile.) he does his job better than Rogan. Rogan has no audience. That is his problem. The man has no sense of delivery or timing. He could write the funniest jokes on earth and they would fall flat coming from him. And for the record, I'm not defending Mencia. Both suck, but in all honesty Mencia is just better at what he does...He may not write his own jokes, but at least he establishes a presence, which may be more important in stand up comedy. That is why he is more successful and Rogan resents it.

Yes, timing and stage presence and all that is important, but all of that can be taught. People work for years to get their bits written to perfection, and you can't just take their work. It's the biggest slap in the face that you can get in the comedy world.

Then like Jag said, be professional about it and sue his ass. The fact that he hasn't makes me wonder if Rogan can actually back up his claims or is just looking to get a little attention.

He hasn't really stolen from Rogan. He did steal 13 minutes of material from George Lopez for an HBO special. I don't know if Lopez is suing Mencia but he did have his lawyers pull the plug on the special. The special aired once or twice and hasn't aired since.

There is a lot of proof. And, Rogan isn't the only one. George Lopez has also accused Mencia and has taken legal action.

The precedent is there, and it wouldn't be too hard to win. The thing is that Rogan ultimatey doesn't need money. He's had two shows make it to syndication, which means he basically doesn't have to worry about money for the rest of his life. Also, most comedians aren't really interested in money, but honor. They want him to stop using their bits, and that's all they really want.

Exactly. And if there's a legitimate claim, organize the comedians who have had their material stolen by Mencia into a class-action suit and sue him blue. Otherwise it's just attention-****ing by Rogan. In fact, I'd say Rogan's doing a disservice to artists everywhere by NOT working to set legal precedence with this issue. Still not anything worth getting my knickers in a twist over, and I say that as an artist myself.

Actually, I think you'll see less and less of Mencia over the next few months. Now that videos like this are starting to surface and his core audience is beginning to find out the truth about his stuff, he's going to start losing steam.

If it is about honor, he can get an injunction set against Mencia stealing material, he can lay down a precedent to scare other people from doing it. Don't give me this whole "Joe Rogan is fighting the good fight" load. He is trying to get attention now that his brief Fear Factor fame has ended and put him in a class of celebrity right up there with The Weakest Link lady.

You give Mencia's High School/College level audiences way too much credit.
 
I'm an artist, and frankly I'd handle it the way you did; offline with some harsh words. I'd probably pull the trigger on a lawsuit, though, rather than just threaten to. The way Rogan and Mencia are going about it comes off as attention-****ing and I don't respect either one of them for it. If some of the people who are up in arms about this didn't know who Rogan or Mencia were, would they even care? I'm guessing probably not.

Agreed.:up: For the very reason that Mencia has never been sued. Especially now that he has gone national. Makes me question the validity of the accusations. You may not Like Mencia. Heck everyone has there own sense of humor, but that doesn't mean that he steals jokes.

It really wouldn't suprise me if this were a publicity stunt. I mean, sure it makes Carlos look bad, but he can afford it. And with Fear Factor having faded to obscurity and no one really giving a damn who Joe Rogan is he could definitely use a jump start.

Again. Agreed:up: I find it funnny that all thoughs seasons of Fear Factor, & not once did I get a sense, that he ever had a sense of humor.

Like I already said, Joe Rogan is just the public spokesman. George Lopez has already taken legal action. His lawyer already forced HBO to stop airing a special with Mencia where he stole 13 minutes of material from Lopez.

Why haven't more actions been taken? Maybe HBO pulled it for another reason? It must not be too solid or there would've been far greater actions taken. If Lopez's attorneys had enough incriminating evidence to get HBO's legal team to say "Yeah, we have to pull this"...then this would've been in court and Mencia would've been taken for millions. As it is, he was not.
 
But Joe Rogan is pretty hot anyway so I hope he wins :o Mencia sucks big time.

I never said he wasn't using it to get known again, I'm saying that he ultimately is doing everyone a favor.

I'm sitting in a college dorm room right now, knowing that a lot of people at my school, as well as my friends' schools are all starting to turn on him. And ultimately, when people's older brothers and sisters star saying he sucks, so will their little siblings in High School. Hell, I started to see a lot fo people in my High School last year tearing Mencia apart.

Like I've been saying, it's not about the money. Lopez wanted his bit to stop being stolen, so he got a very lucrative deal for Mencia pulled. Lopez definitely doesn't need to worry about money, just about protecting his act from jackasses like Mencia.

Perhaps, I mean, I don't know all of the legal technicalities that would be involved, but I'm sure that if Mencia were to fight back in court, his digressors would do just the same.

People just seem to be believing because they don't like Mencia.

Did you watch the video? While it isn't enough to prove it in court, it certainly is enough to confirm a lot of peoples' suspicions. And I'm sure that there is plenty more where that information came from, so I doubt he would have trouble proving it.

Not really, Mencia is arguing those are all fairly generic routines...in which case all he would have to do is provide evidence of a couple other people using some variation, and suddenly he walks away scott free.
