I wonder how many morons have gone looking for that photo, only to set themselves up for a child pornography charge by having it on their computers or phones? The very thought of perverts getting caught out that way warms my heart.

The threat of child porn charges could be a useful tool in getting people in that family's area to stop passing around the photo. Throwing everyone who accesses the photo in jail and maybe putting them on a sex offender registry would be a great way to stop the "Herp derp, is the little girl hot?" guys dead in their tracks.

Child porn includes sexually explicit photos taken of minors. Nudity is not a requirement.

I don't think she'll be charged once all is said and done. She should be, but she likely won't IMO. Though I would bet at this point, the public shame and humiliation the family is feeling will have some lasting effects.

Best intrest of the child perhaps. That is not a proper environment for a child to be in thus grounds for being taken out of her custody.

Actually, in some jurisdictions, including Canada, even a fictional depiction of minors in a sexually explicit scenario constitutes child pornography. That can include drawings and even writings.

So basically if I drew a simple stick figure, with an arrow pointing to it with the words "this is a topless 15-year-old in a sexually explicit pose" I would technically be breaking the law.
