Manholes are required to stay covered at all times, unless their are workers present, and at that time sufficient warning has to be present. such as a sign, cones, barriers, etc.

Yeah, but come on. How is a cone or anything going to stop someone who is not watching where they are going. If she couldn't see the manhole, how could she see a cone or sign? And, last time I checked, manholes are usually located on a road. Why the **** was she texting while on a street, with cars. It's common sense.

But lets say everything I said is false, and I'm stupid. Sueing because she got scared, and minor scratches? Maybe if she suffered broken bones or head injuries, yes. But because she got scared? Then I should go out and sue the wax museum near my house, that scares me.
