Shoot the person for not paying attention & falling down an open manhole, then shoot the person who left the cover off the manhole cover without any sort of barrier or someone watching, both are as stupid as each other..

I don't see why people are so surprised the family wants to sue. This country is full of sue happy people that they will for anything. The girl has a case because it was not properly marked off.

However, marked or not it is pretty easy to see an opened manhole cover when one is supposed to be paying attention. If texting was that important to the girl she could have just stood safely on the sidewalk and sent the message and continued walking.

I used to see kids walking and texting and they would slam into walls and other people because they have no regard for anyone or anything when one their phones.

It's like the people who talk on a cell phone and drive. You don't have your full attention on the road no matter how well you think you can drive.
