Good question! It depends when Xavier is eliminated, and maybe they are aware that there are many mutants with psychic powers.

In the screen cap from the new trailer where it shows jeans legs and Prof X is in the wheel chair, well Magneto is in the back ground in the kitchen. He is on the floor leaning against the kitchen cabinets. This looks to be the scene where previously we saw Magneto screaming. I think his helmet would not be enough against Jean if she really pushed it.

Maybe you're not supposed to 'get it' yet. After all, we've only seen four minutes of material so far, in both trailers. Don't expect to be able to piece together the entire movie from that.
 
The Prof is wearing the same suit in the scene where they are outside walking with Mags in Jeans neighbothood as he is in the scene where Jean is lifting him out of the chair. I would take a guess that this is within the first half of the movie. After Jean has run away, They go to her neighborhood chasing after her. Mags has learned of Jeans existance (more powerful than you) and he went to talk with her as well to bring her to the brotherhood side. When the Prof and Mags go inside the house they find Jean changing into her new clothes (the scene lifting the Prof shows her unitard and shirt) and in a bad mood. She fights with them and Storm then fights with the brotherhood outside the house. Somehow Jean goes with Mags and perhaps the scene with the empty wheel chair and Storm/Wolv is after this (perhaps Jean killed the Prof at that point). Just a theory based on what I have scene so far. Maybe wrong.
 
Really looking forward to another go-round with Magneto...hopefully they don't hold back on his powers. Seems like FOX spent a pretty coin on that Bridge sequence, hope it it's a holy **** moment.
 
In the trailer where he is against the kitchen cabinets screaming, I am convinced that he is screaming "CHAAAAAAAARLES" - watch it in super, slow-mo. :-)

That is what i have concluded from the trailer aswell.

Jean is telekinetic unlike Prof X, she could just rip the helmet off first if she really wanted to.
There are a lot of telepaths that could be around, so if he has this kind of technology I can't imagine that he would ditch it. If he's not wearing it where would he keep it.

Tell me about it. I just watched the trailer again, and he is so right about it. Magneto is on the floor in the kitchen (Phoenix obviously smashed him beforehand or is holding him there while she finishes her buisness) and he is screaming, because Xavier is about to be killed right before his eyes. That's actually really sad. :(

From what we've seen so far, it look's like Magneto will be using his powers very aggressively in X3.

If that's a strong enough way to put it. From what I seen in the trailer, it looks like he's gonna go all out this time. The whole Golden Gate Bridge crisis still in mind, he seems mightily pissed off and really determined to vanquish the humans once and for all. I like that. ;)

As he said himself "Fury that this world has never witnessed!".

I think it's the best line I've heard him say (emotionally) in these films & there have been many good ones.
