The ADA is a wide-ranging Civil Rightslaw that prohibits, under certain circumstances, Discrmination based on disabilty in the same way that the Civil Rights Act of 1964 affords similar protections against discrimination based on race, religion, sex, national origin, and other characteristics illegal.

A Disability is defined as "a physical or mental impairment that substantially limits a major life activity."And the accommodations to the disable from the state.

Handicapped parking regulation are covered under Title III.

"Public accommodations" include most places of lodging (such as inns and hotels), recreation, transportation, education, and dining, along with stores, care providers, and places of public displays, among other things.

If an employee with a disability needs such accommodation in an older parking lot, s/he should request it of the employer.

Parking Space Size: Accessible spaces should be at least 8 feet wide, with level access aisles not less than 5 feet wide. Two accessible spaces may share a common aisle.

Location: These spaces should be in a level location providing the shortest safe, accessible route of travel to an accessible entrance. With more than one accessible entrance, the spaces should be located near each accessible entrance, the space should be located near each accessible entrance. Sidewalks at such spaces should have curb cuts at each access aisle, so a person is not required to enter the stream of traffic to get to a sidewalk.


Or in other words... if a place of buisness provides parking for its customers... then it must provide safe and convient parking for it's disable customers.

Also any multiable rental housing business's must also provide safe and convient parking ALL it's disable tenants.

The federal fair housing regulations state that property owners must
  • Make reasonable accommodations at the owner's expense for tenants with disabilities, so they can enjoy the rental property on an equal basis.
  • Make reasonable adjustments to their rules, procedures, or services upon request. A common example would be providing a wider and more convenient parking space, when practical.

And the state or a property owner can decline to give a Disability parking tag to a blind person simply based on weter he drives.The parking hang tag can be used by any family member that transports the disable person from place to place.

As a mater of fact under the law the state or a property owner cant even ask as to the nature of the Disability.All they can do is ask for proof of a Disability such as documentation from your doctors or your SSD information.

I can't remember the last time I didn't go a day without someone calling for assistance at Wal-Mart 'cause they saw someone park in the Accesible spaces then sprint inside.
