In that case... I dont buy it for one minute!... If there is a spider-man 4, and there WILL be a spider-man 4 eventually, then Maguire will be back!!

Tobey will have to renegotiate his contract for the fourth movie. He´s most likely going to ask for quite a bit of dough, and if he wants Sony to pay for it, he needs to create a demand for his permanence. But yeah, sooner or later he´ll have to leave the franchise.

There were real issues with his back, but there was also a point where Tobey just didn't want to do Spidey 2, and had to be convinced by his girlfriend's dad (a big movie mogul) to do it.

Jake Gyllenhal was very close to being Spidey.
